Familysearch.org Written: 1830 pg 53 Bill of complaint of Jesse Averitt Admin. de bonis non of Thomas Veal, of Dempsey Veale, of John Robbins, Admin Executor of Richard Veale, of Agnes Veale, of Pegga Ruffin and Catherine Grimes of the state of Tennesse & of John Robbins & wife Rachel the Executrix of Thomas Veal... [note Rachel widow of Thomas Veal Jr. married John Robbins] Thomas Veale the elder late of Bertie County died some time in the year after having made & published his last will & testament . The testator bequeaths among other things as follows. I lend to my loving wife Elizabeth Veale six negros named as follows. Mingo, Stephen, Tony, Hannah, Dinah & Sarah during her natural life or widowhood. The testator in the latter part of his will bequeaths as follows, "and after her death or marriage my will & desires is that the property I have lent to my loving wife, Elizabeth Veale may be equally divided between all my children and their heirs lawfully begotten of their bodies forever. That Elizabeth the widow of the testator received the slaves bequeathed to in said will as above stated & died in 1829. That your petitioner Jessee Averett is the Adminstrator de bonis non of the testator Thomas Veale & has the slaves in possession. That Dempsy Veale, Richard Veale, Agnes Veale, Pegga Ruffin, Catherine Grimes pg.54 & Thomas Veale Jr. were the children of the testator Thomas The Testator living at his death. That Richard & Thomas Veale both died before the widow Elizabeth. That Richard Veale by will gives the residue of his property to his children & wife. A copy of the will of Thos Veale is hereto annexed. That Thomas Veale also made a will & testament & gave all his estate to his wife Rachael he leaving no ?? [opus ) and appointed her his executrix. That said Rachel is now the wife of John Robbins your orators & oratrix being desirous that partition of this said slaves & their measure should be made among them according as they may be satisfied thereto & your Orators being desirous to have the several & respective rights of the parties settle by this Court & being also desirous to avoid litigation & your orator Jesse Averett being the Administrator of Thomas Veale the ___ & deserees that a decree of the Court should decide & settle to whom said Slaves belong. Your Orator pray your Honor to declare to whom the said slaves belong under the will of Thomas the elder & that division may be made among your orators & oratees according to the proper construction of the said will & ___ will pray. Equity Court March Term 1830 Jesse Averett Adm de bonis non of Thomas Veale the Elder, Dempsey Veale, John Robbins, Executor of Richard Veale, Agnes Veale, Pegga Ruffin, Catherine Grimes of Tennessee and John Robbins & wife Rachael, Executrix of Thomas Veale Junior. Petition for division of Negroes This Cause coming on to be heard departee, on the Petition of the Complainants and the several allegations there in set forth, and the will of Thomas Veale Senior, proved at May Term of Bertie County Court A.D. eighteen hundred and six being examined and the two clauses in said will in relation to the six negroes and their increase as set forth and named in said Petition, being examined by the Court: It is considered by the Court, that all the children of Testator Thomas living at his death took a vested absolute interest in the slaves, but that said slaves belonged to Widow Elizabeth for life; said that on her death, the Petitioners, who are the children of the Testator, living at her death and the representatives of such children as were then living and have since died, are entitled to said slaves. That Dempsey Veale is entitled to one share, John Robbins, Executor of Richard Veale, to one share. Agnes Veale to one share; Peggy Ruffin to one share, Catherine Grimes to one share. John Robbins and wife Rachael Executrix of Thomas Veale Jr to one share; And it is ordered and decreed that the Petitioner Jesse Averett Adm de bonis non of Thomas Veale the Elder pay over said slaves accordingly. It is further ordered that William Pugh, James G. Mhoon, William S. Mhoon, William B. King and Thomas J. Pugh or any three of them be appointed commissioners to divide said slaves among the Petitioners, according to the above decree: And that the cost be paid by the Administrator de bonis non of Thomas Veale Senr out of the funds arising from said slaves in his hands or by the other Complainants. And it is ordered and decreed accordingly. 65 66 We the undersigned commissioners by virtue of the annexed order and decree from Bertie Court of Equity March Term 1830 have met this first day of April in the same year at the store of Mr. Robert C. Additional Comments: After death of Elizabeth Carney Veale, in 1829, widow of Thomas Veale, Sr. the Estate is divided among the living heirs. One son, Maurice Veale, had died before Thomas, the father. By 1830, sons, Richard and Thomas were also dec'd.
