All rights reserved. http://www.usgwarchives.net/copyright.htm File contributed for use in USGenWeb Archives by Lisagraham32@aol.com Lisa Graham http://www.usgwarchives.net/nc/bertie.htm Barns to McWilliams This indenture, this Fourteenth Day of February One Thousand Seven hundred and Thirty Seven by and between James BARNS of BERTIE Precinct, of the one part, and John McWilliams of the other part, witnesseth, that for inconsideration of the sum of fifty pounds Current money of Virginia, in Hand paid by the said John McWilliams, the receipt whereof the said James Barnes doth acknowledge himself. his heirs, executors and administrators there with fully contented and paid, have bargained, sold, set over and confirm and by these presents do freely, fully and absolutly, grant ,bargain, sell, convey enfeoff and confirm, set over and deliver unto the said McWilliams, his heirs and assigns forever a certain plantation of mine that I bought of JOSEPH WIMBERLY and one hundred and eighty acres land, be the same more or less, one hundred and forty of the one hundred and eighty that did formerly and doth still belong to the plantation, the other Forty begineth and is bounded thus:-Beginning at a Stake standing by the side of Jonathon Tart's Meadow, thence along a direct line of markt trees to ROBERT RUFFIN'S LINE, the other bounds is , and will appear by Deed given from WIMBERLY to ME. To have and to hold the said Hundred and Eighty Acres of land, be the same more or less, together with all houses, gardens, pastures and Orchards or trees of any kind, standing, lying or growing thereon, with all woods, water and water Causes, with all commodities, hereditaments and Appurtenances to the same or any part thereof assertaining a belonging unto the said, John McWilliams his heirs and assigns forever, and further I, the said Barnes do covenant and agree, for myself, my heirs, executors and administrators by and with and with the said McWilliams his heirs and assigns forever, in a manner and form (that is to say) That he, the Said James Barnes at the sealing and Delivery of these presents, hath a good, lawful estate and inheritance to and in the bargained premises and to every part thereof in fee simple and hath full right and lawful Authority to sell and dispose of the same and every part thereof in manner and form aforesaid, unto the said McWilliams, his heirs, and assigns forever, and I, the said Barnes, do further promise and oblige myself, my heirs, exec, to the said McWilliams, his heirs and assigns forever to Warrant, maintain and defend the said demised premises and every part thereof unto the said McWilliams, his heirs and assigns forever from the just claim or claims of any person or persons whatsoever claiming by me, my heirs, exec or administrators or any other way or means whatsoever, and that the said demised premises be free and clear from all incumbrances whatsoever, and the same will Warrant, secure and defend, unto the said McWilliams, his heirs and assigns forever.
