B. Ruffin*** This indenture made this 26 day of January in the year of our Lord, One Thousand Nine hundred and 12 between Augustus Bass and Martha A. Bass of the County of Bertie and State of North Carolina, of the second part; witnesseth: That the said parties of the first part, for and in consideration of the sum of Three Hundred Dollars, in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, have bargained and sold, conveyed and confirmed, and by these presents do bargain, sell, convey and confirm unto the said party of the second part, his heirs and assigns, forever, all the following described piece or parcel of land, lying and being in Bertie County & in Colerain Township and known as designated as follows, viz: Begining at on the Coleraine Road near J. T. Trumml, a ditch, thence a north course to a gum in Pond near the center of plantation thence due north to J. A. Manning line thence along Manning line to Blunt Rayner line Thence along Blunt Rayner line to W. E. Bennett line, Thence along Bennett line to the Coleraine Road, thence along said road to place of begining a ditch and said to contain 50 acres more or less. To have and to hold the same, together with all the hereditaments and appurtenances thereunto in anywise appertaining to him the said Dr. J. B. Ruffin his heirs and assigns forever. And the said Augustus Bass & Martha A. Bass parties of the first part, do covenant with the said party of the second part and their heirs and assigns, as follows: First, That they are the owner and lawfully seized of said premises. Second, that they have good right to convey same. Third, that the same is free from all incumbrances whatever. And Fourth, that the party of the second part & his heirs and assigns shall quietly enjoy and possess the same and that they will warrant and defend the title to the same against all lawful claims, provided nevertheless, that if said Augustus Bass & Martha A. Bass of the first part or their heirs, executors and administrators, shall well and truly pay or cause to be paid to the same Dr. J. B. Ruffin party of the second part his heirs, executors, administrators or assigns, the sum of Three Hundred dollars, according to the condition of a certain note of even date herewith payable January the first 1915, then this deed to be null and void; otherwise to be in full force and effect. But if default shall be made in the payment of either of the said sum of money or the interest, or any part thereof, at the time hereinbefore specified for the payment thereof, the said parties of the first part, in such case do hereby authorize and fully empower the said party of the second part his heirs, executors, administrators and assigns, to sell the said hereby granted premises at public out-cry at the Court House door in Windsor Bertie County after first advertising the same as the Law directs and convey the same to the purchaser in fee-simple, and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said note together with all cost and charges, and pay the surplus if any to the said parties of the first part, their heirs, executors, administrators or assigns. In testimony whereof, the said parties of the first part ha..hereunto set their hands and seals the day and year first above written. Signed, sealed and delivered in the presence of Augustus Bass (Seal) Martha A. Bass (Seal) North Carolina, Bertie County. I, W. S. Tayloe, J. P. do hereby certify that Augustus Bass and Martha A. Bass his wife personally appeared before me this day, and acknowledged the due execution of the annexed deed of mortgage, and the said Martha A. Bass being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same; doth state that she signed the same freely and voluntarily, without fear or compulsion of her husband or any other person and that she doth still voluntarily assent thereto. T. Trumml mentioned in the deed was John T. Trumble.
