This Indenture made this fifth January 1822 Between Blount B. Buffin and Rachel Ruffin of the State of North Carolina & County of Bertie of the one part & William B. Spivey of the Same State and county aforesaid Witnesseth that the said Blount B. Ruffin & Rachel Ruffin for an inconsideration of the sum of Two hundred Dollars To us in our hands paid by the said William B. Spivey Do by these presence Give Grant bargain & here unto him the Said William B. Spivey his heirs and assigns forever one certain tract parcel or message of land Lying and being on the north side Rouquist Swamp Containing by estimation Sixty Acres be the same more or less bounded by the lines Jacob Garrett Humphrey Lawrance Nancy Clark & Reubin Parker for Particular Reference Look To Division in lands of Jacob Garrett dec'd it being Rachel Garrett part of Land that fell To her in Division of her father Jacob Garrett Decd To Have & To hold unto him The said William B. Spivey and ! we the said Blount B & Rachel Ruffins will warrant & forever defend unto him the Said William B. Spivey his heirs executors administrators and assigns forever & free from the claim or claims of any person or persons whatsoever and free from our heirs executors administrator & ourselves. In Witness wherof we have hereunto set our hands & seals this year & date above written Blount B. Ruffin Rachel Ruffin Witness James Cherry Sara Grimes State of North Carolina Bertie County Feby Term 1822 This Deed from Blount B. Ruffin and Rachel his wife to William B. Spivey was exhibited in open Court for probate and the execution thereof by Blount B. Ruffin was proved in open Court by the oath of James Cherry one of the subscribing wintesses thereto, whereupon it was considered by our said Court that Commission assign to James Cherry and Justin Askew Esquires to examine the Said Rachel separate and apart from her Said husband, whether she executed the Said Deed of her own free will and consent and that they make return thereof to next Court Signed E. A. Rhodes Clk State of North-Carolina, Bertie County. To James Cherry & Justin Askew Greeting: Whereas Wm. B. Spivey hath produced a Deed of Conveyance made to him from Blount B. Buffin and Rachel his wife, of a certain Tract or parcel of Land lying and being in the County of Bertie, in the State of North-Carolina, and produced the same to be proved in the Court of Pleas and Quarter Sessions of Bertie County; and it being represented to our Court that Rachel the wife of said Blount is an inhabitant of the said State, and of Bertie County, and is so infirm that she cannot travel to our said Court to be privily examined as to her free consent in executing the said Conveyance. Therefore we command you, or any two of you, that at such certain day and place as you shall think fit, you go to the said Rachel if she cannot come to you, and privily and apart from her husband, examine her the said Rachel whether she executed the said Conveyance freely and of her own accord, with! out fear or compulsion of the said Blount her husband; and the examination being plainly and distinctly wrote on the said Deed, or on some paper annexed thereto; and when you shall have so taken the said examination, you are to send the same closed up under the seals of you or any two of you, together with this writ, unto our said Court, to be held for the County of Bertie aforesaid, on the second Monday in May next ensuing. Ruffin concerning The conveyance of The annexd Deed who sayeth that She did assign the Deed with her own free will and consent with out fear or compulsion from her husband Blout B. Ruffin or any other person Given under our hands the dated year above written James Cherry J.P. Justin Askew J.P. State of No Carolina Bertie Co. Court May Term 1822 This Deed form Blount B. Ruffin and Rachel his wife to William B. Spivey together with the Commission & private examination of the Rachel was returned to this Court - ordered that the Same be registered E. A.
