This indenture made this day of January Anno domin 1749
and in the year of the reign of our Sovereign Lord King
George the second King of Great Britain. Between Barniby
BRYAN of Bertie County of the Province of North Carrolin
on the one part and Needham BRYAN of the same county and
Province aforesd of the other part Witnesseth that I the
sd Barniby BRYAN for diverse good causes and
consideration me their unto moving Have given, granted,
bargained, sold, aliended, conveyed and comfirmed and by
these presents do freely fully and absolutely given,
grant, bargain, sell, alien, convey and confirm the said
Needham BRYAN his heirs and assigns forever one messuage
or tract of land and  Plantation. 

In Bartie County
scituate lieing and being in the county aforsd containing
by estimation one hundred ac be it more or less butted
and bounded 

beginning upon Flag Run at the mouth a a
branch that runs out northward from the Run the dividing
line between William VAN and Him 

thence up the branch to
the head thence along a loyn of marked trees to the
headline of the survay to a pine the corner 

thence along
the head pine to the head of Flag Run 

thence along the
run to the first station. to have to hold the said
granted and bargained premises with all the
appurtenances, privilidges, and comodities to the same
belonging or in any wise appertaining to Him the said
Needham BRYAN his heirs and assigns forever to his and
their own proper use benefit and behoof forever and I the
said Barniby BRYAN for one my heirs Exe and Adm 's do
covenant promise and grant to and with the said Needham
BRYAN his heirs and assigns that before the ensealing
hearof I am the trew sold and lawfull oner of the above
bargained premises and am fully seized and possess of the
same in any own proper right as a good, perfect and
absolute Estate of Inheritance in fee simple and have in
my self good right full power and lawfull authority to
grant, bargain, sell, convey and confirm the said
bargained premises in manner as aforsd and that the said
Needham BRYAN his heirs and assigns shall and may from
time to time and at all times forever hearafter by force
and virture of these presentslawfull peaceable and quiety
have hold use occupy and enjoy the same demised and
bargained premises with the appurtenance free and clear
and freely and clearly acquitted exonerated and
dischzrged of and from all and all manner of former and
other gifts, grants, bargains, sales, leases,
mortgages,will, entails, joynture, dowries, judgments,
executions, incumbrances and extents and further more I
the said Barniby BRYAN for myself my heirs Exes and Adm
do covenant and promise at and upon the reasonable
request and at the proper cost and charges of the law of
the sd Barnaby BRYAN his heirs and to make do perform any
futher or other lawfull and reasonable act or acts thing
or things device or devices in the law needfull or
requisite for the more perfect assurance settling and the
shure making the premises as aforesaid provided
nevertheless and it is the tru intent and meaning of
grantor and grantee in these presents any hearin
contained to the contrary notwithstanding that if the
above named Barnyby BRYAN his heirs Exe adn Adm or
assigned do well and trewly pay unto Needham BRYAN his
heirs or assigns the sum of twenty one pound one shilling
and eight pence silver money 15 waite to the Crown by the
Twenty day of January next come two year thenthis above
written deed or obligation and every clause and article
theirin contained shall be null and void and of none
effect or else shall abide in full force and virture
sealed with any seal or dated in the month and day and
year first above written.
