All rights reserved. http://www.usgwarchives.net/copyright.htm File contributed for use in USGenWeb Archives by Marianne Ordway mordway@adelphia.net http://www.usgwarchives.net/nc/bertie.htm Bertie County, NC Deed Book pg's 171 & 172 ~ Alcany Dempsey & Wife To: Deed Elizabeth Willoughby This indenture made this twenty-first day of May in the year of our Lord one thousand eight hundred and fifty one between Alcany Dempsey and wife Celia Ann Dempsy of the State of North Carolina and County of Bertie of the one part and Elizabeth Willoughby of the other part, witnessed that the said Alcany Dempsy and wife Celia Ann Dempsy for and in consideration for the sum of eighteen dollars to them in hand paid by the said Elizabeth Willoughby the receipt whereof is here by acknowledged have bargained and sol and by these presents doth give, grant, bargain and sell unto her the said Elizabeth Willoughby her heirs and assigns all of said Albany Dempsey’s and wife Celia Ann Dempsey’s interest and right in and to the land belonging to the estate of John Willoughby deceased lying in the aforesaid county of Bertie, bounded by the land of David Hoggard Asa F. Early and others to Have and to Hold the above bounded and sold premises to her the said Elizabeth Willoughby her heirs and assigns forever, and the said Alcany Dempsy and wife Celia Dempsy their Heirs, Executors, administrations and assigns doth covenant and agree to and with the said Elizabeth Willoughby her heirs, executors, administration and assigns to warrant and defend all the right and title vested in said Alcany Dempsey and wife Celia Ann Dempsey in the above bounded and sold land forever free and clean from all manner of encumbrances, in Witness whereof the said Alcaney Dempsey and wife Celia Ann Dempsy doth hereunto set their hands and seal this day and date first about written. Signed, Sealed and delivered} Alcany Dempsey {seal} [his mark] } Celia Ann Dempsey {seal} [her mark] in presence of Willie Dunning Joseph G. Willoughby H.H. Hardy State of North Carolina Bertie County Court Aug. Term 1851. The execution of the foregoing deed from Alcany Dempsey and wife Celia Ann Dempsey to Elizabeth Willoughby was proved in open court by the oath of Willie Dunning one of the subscribing witnesses thereof. Whereupon, it is ordered by the Court that H.H. Hardy one of the justices of said Court examine the said Celia Ann Dempsey separate and apart from her husband privately concerning her free and voluntary execution of said Deed, The said H. H. Hardy one of the Justices having made said examination within the verge of the Court, reports that he examined the said Celia Ann Dempsey separate and apart from her husband and that she saith that she executed the said deed freely and voluntarily and without any constraints or compulsion of her husband and that she doth now assent to the same.
