Driskill MDriskill@worldnet.att.net To all People to whom there present writing shall come I John Freeman of the County of Chowan in the Province of North Carolinas Send Greeting in our Lord God Everlasting June the Twentieth Day 1747 in the Twentieth year of the Reign of our Sovereign Lord George the Second by the grace of God of great Brit. France & Ireland King Defender of the faith. Now Know yee that I the said John Freeman Send greeting And that I the said John Freeman out of the Natural love good will and Effection that I Have towards my well beloved Brother Samuel Freeman Now of the County of Bertie in the Province afores. and more Especially out of the full Complying & fulfilling of the Last will & Testament of my Father William Freeman Sate of Chowan County Deed which said Will was Duly Proved in Due form of Law before Wm. Smith Esq. Chief Judge of the Province aforcs. & by him ordered to be Recorded & by the Secretary of land Mislaid or accidentally Lost as it appears & is not now to befound which said will Did give & bequeath this hundred & forty acres of Land to any two Brothers Aaron & Samuel Freeman & Aaron Freeman now being Deceds before he was of lawful age & Dieing Intestate his Inheritance Descending to me the said John Freeman being the Eldest Brother & heir in law I the said John Freeman afores. Do by these present give, grant, Promise, Release, Quit Claim, In peoples make over Confirm unto the said Samuel Freeman his being & assigns the afores. Six hundred & forty acres of Land Scihiated lying & being in Bertie County afors. Beginning at a live oak Standing on the west side of a Swamp Commonly Known y the Name of the Cyprus Swamp being a corner tree of Coll. William Mauls then along the said Mauls Line N. 55 W. Three hundred & Twenty Poles to a Pine, then at o54 W. 340 Pole to a Black oak, then o55 E. 320 Poles to a Cyprus in the afo. Cyprus Swamp, then Down the afo. Swamp by Various Cousins & bounded thereon to the first Station be it Six hundred & forty Acres more or less the valid Land being a Patent formerly granted toty Acres as by a Patent bearing Date the first Day of April which was in the year of our Lord Christ Seventeen hundred &Twenty three Doth & May appear by the said Henry Roads Sold & Conveyed to William Freeman being the Lawful father of the afors. John Freeman & Saml. Freeman both the Parties to these presents as by an assignment on the Back of the afores. Patent under the said Henry Roads hand & Seal bearing Date the Twenty Second Day of September which was in the year of our Lord Christ Seventeen hundred & Thirty Three Doth & may appear To have and to hold unto the said Samuel Freeman his heirs & assigns with all the Rights members & apprise Hereof with all houses, orchards, cleargrounds, woodland grounds with all woods, water, trees & Timber Trees, Meadows and Meadow ground, waters & water Courses In ground Swamps Marshes, Springs & Fountains and all other Liberties & Privileges therein & thereon contained, And He said John Freeman for himself his heirs Exd. adm. & assigns Do by these present Promise and Warrant at the Ensuring & Delivery hereof that they have a good Right, title & Estate in the ... in Fee Simple the aforesaid will only Excepted have in themselves full Right & Lawful Authority to give, grant, remise, release, & forever Quit claim the afors. Land & Promise with all & singular the appearances unto the said Saml. Freeman is heirs & assigns forever And that the said Laws of ...with all & Singular the appearances now are & So Shall be may forever hereafter remain Continuous & be unto the said Samuel Freeman his heirs & assigns free & freely Clear & Clearly acquitted exonerated of & from all & all other or former gifts, grants, Leans, Sales, mortgages, Deed, bonds, Judgments, wills, Intails of the will, before mentioned only Excepted for futures Rents, or arranges & Rents of all other Encumbrances or what Nature & kind s\foever but that the said Samuel Freeman his heirs & assigns shall of Lawfully may from time to time & at all times hereafter Peaceably & Quietly have hold, occupy Poppe. & enjoythe Lawful Let Suit trouble, Denial, Disturbance, molestation, Interruption & Eviction of him the said John Freeman is heirs or assigns or any other Person or Persons claiming from by or unto him them or any of them or any other Person or Persons whatsoever that Shall or may Say any manner of Lawful Claim thereunto or any Part or parcel thereof and the said John Freeman for himself his heirs Exec. Adm. & assigns Do by these presents Covenant grant & agree to & with the Said Samuel Freeman his heirs & assigns to make any further or other lawful act Conveyance or Devise at any time or times within Seven years next Insuring the Date hereof at the Reasonable Request of him the said Samuel Freeman his heirs or assigns or their or Either of their Learned Council in the law shall Devise or advise for the further & better assuring & sure making the afors.
