The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. ====== Bertie County Deed Book F 122 To all people to whome these presents shall come I Robert ELLIS of Bertie County in North Carolina send Greeting in our Lord God Everlasting now Know ye that I Robert ELLIS for and in consideration of the sum of Twenty five pounds Currency of Virginia to me in hand before the Ensealing hereof will and truly paid by Phillip SMITH the receipt whereof I do hereby acknowledge and my self therewith fully satisfied and content and thereof and of every part and parcel thereof do exonerate, acquitt and discharge the said Phillip SMITH his heirs Execs forever by these presents Have given, granted, bargained, sold, aliened, conveyed and confirmed unto him the said Phillip SMITH, his heirs and assigns forever, one messuage or Tract of Land containing three hundred acres of land be the same more or less scituate lying and being in Bertie County Between Emanuel ROGERS and Phillip SMITHs land, Late John GRAYS Land beginning at a maple on the ___side, Phillp SMITHs corner tree so with his lines to the center of three white oaks, another of the said SMITHS corner, so to another corner white oak dividing the said ELLIS and the heirs of Robert ELLIS dec'd so with a line of marked trees in and by a small drean to the corner field of the said ELLIS and Robt dec'd and through the sd field and ___ to a corner pine thence to a corner red oak, Emanuel ROGERS then with his line to the river thence up the river to the first station where it begun. To have and to hold forever the said granted and bargained premise with all the appurtenances, privileges and commodities to the same belonging or in anywise appertaining with all houses, orchards, clear grounds, woodland grounds, pasture grounds, swamp pocoson water and water courses and all other liberties therein and thereon contained to him the said Phillip SMITH heir heirs and assigns forever to his and heirs only proper use, benefit and behoof forever and I the said Robt ELLIS for me, my heirs, Exec', adms do covenant, promise and grant to and with the said Phillip sMITH his heirs and assigns that before the ensealing hereof I am the true sole and lawfull owner of the above bargained premises and am lawfully seized and possessed of the same in mine own proper right as a good, perfect and absolute Estate of Inheritance in fee simple and have in my self good right, full power and lawfull authority to grant, bargain, sell, convey and confirm the said bargained premises in manner as above said and that the said Phillip SMITH, his heirs and assigns shall and may from time to time and at all times hereafter by force and virtue of these presents lawfully, peaceable and quietly Have, use, occupy, possess and enjoy the said demised and bargained land and premises with all the appurtenances free and clear and free and clear and freely and clearly acquitted, exonerated and discharged of from all and all manner of former grants and other grants, gifts, bargains, sales, leases, mortgages, wills, entails, , joyners, dowries, judgments, executions, incumbrances and extents. Furthermore I the said Robert ELLIS for my self my heirs, exec, adms do covenant and engage the above demised premises to him the said Phillip SMITH his heirs and assigns against the lawfull claims and demands of any person and persons whatsoever forever, hereafter to warrant, secure and defend the sale of the same. In witness whereof I have hereunto set my hand and seal this ninth day of February in the year of Our Lord 1740: Robert ELLIS his mark and seal Signed Sealed and delivered in presence and sight of us_ Robert HARRIS, Jurat, John WILLEY, John MOOR Bertie County ye February court 1739 The above deed of sale was duly proved in open court by the oath of Robert HARRIS one of the subscribing witnesses thereto ___ ____motion is ordered to be registered.
