I Robert ELLIS of Bertie County in North Carolina send Greeting in our Lord God Everlaster. Now know ye that I Robert ELLIS for and in considertion of the sum of twenty five pounds current money of Virginia to me in hand before the ensealing hereof will and truly paid by Phillip SMITH the receipt whereof I do hereby acknowledge and my selfe therewith fully satisfied and content and thereof and of every part and parcel thereof to exonerate acquire and discharge the said Phillip SMITH his heir executors forever by these presents have given granted bargained sold aliened conveyed and confirmed unto him the said Phillip SMITH his heirs and assigns forever one messuage or tract of land contained three hundred acres of land be the same more or less situate lying and being in Berties County between Emanuel ROGERS and Phillip SMITH, land late John GRAYS land begining at a maple on the River side Phillip SMITHS corner tree so with his lines to the center of three white oaks another of the said SMITHS corner so to another cornern white oakdividing the said ELLIS and the heirs of Robert ELLIS dec'd So with a line of mared trees in and by a small drean to the corner field of the said ELLIS and Robert dec'd and throught the said fields and ___:to a corner pine thence to a corner red oak Emanuel ROGERS then with his line to the River thence up the River to this first station where it begun. To have and to hold forever the said granted and bargained premiss with all the appurtenances priviledges and commodities to the same belonging or in any wise appertaining with te houses orchards clear grounds woodland grounds pasture grounds swamp pocoson water & ater courses and all other liberties herein and thereon contained to him the said Phillip SMITH his heirs and assigns forever to his and theirs only proper use benefit and behood forever and I the said Robt ELLIS for my my heirs Executors adms do covenant promise & grant to and with the said Phillip SMITH his heirs and assigns that before the exsealing hereof I am the true sold and lawfull owner of the above bargained premises and am lawfully seized & possessed of the same in mine own proper right as a good perfect and absolute estate of inheritance in fee simple and have in my self good right full power and lawfull authority to grant bargain sell convey and confirm the said bargained premises inmanner as above said and that the said Phillip SMITH his heirs and assigns shall and may from time to time and at all times hereafter by forever and virtue of these presents lawfully peaceable & quietly have use occupy possess and enjoy the said demised and bargained land and premisese with all the appurtenances free & clear and freely and clearly acquitted exonorated and discharged of from all & all manner of former grants or other grants gifts bargains sales leases mortgages will entails joynters dowries judgments executions incumbrances & extents. Furthermore I the said Robert ELLIS for my self my heirs executors administrators do covenant and engage the above demised premises to him the said Phillip SMITH his heirs and assigns against the lawfull claims and demands of any person or persons whatsoever forever. Hereafter to warrant secure and defend the sale of the same.
