K443  Aaron ELLIS to James MORRIS 1765

This indenture made this nineteenth day of March in the fifth year of the reign of our souvereing Lord George the third by the grace of God of Great Britain France and Ireland. King defender of the faith and so forth and in the year of our Lord Christ one thousand seven hundred sixty five Between Aaron ELLIS of FLAG RUN Chapple in Bertie County and Province of North Carolina in Brittish America  ___? of the one part and John MORRIS minor  __?between three and four years of age and James MORRIS the father of the said John MORRIS both of the said Chapple County and Province of teh other part.Witnesseth that the said Aaron ELLIs for and in consideration of the sum of twenty pounds sterling to him the said Aaron ELLIS now in hand paid by the said John MORRIS through the handes of the said James MORRIS the said sum being a free gift of the said James MORRIS to the said John MORRIS for the purposes herein mentioned, then receipt whereof he the said Aaron ELLIs doth hereby acknowledge and for himself his heirs exe and adms forever acquit both the said John MORRIS and the said James MORRIS their and each of their heirs Exe and Adm and assigns and of every farthing of said sum by these presents as alien doth the said James MORRIS for himself  __? heirs Exe and Adm forever acquit the said John MORRIS his heirs Exe Adm and assigns of every farthing of the said twenty pounds hath bargained sold granted aliend and confirm and by these presents doth bargain sell grant licence and conform unto the said John MORRIS and his assigned and in default of such assign to the heirs of his body and there assigns forever But on the death or extmition of all such heirs without any assign or assigns for the whole or part the nall or such unassigned part or parts to the said James MORRIS and the person or persons whom he shall nominate hire representateve or represenatives these to by deed or will their heris and assigns forever and in default of such nomination to the heirs at law of teh said John MORRIS their heirs and assigns forever Two hundred acres of land mor or less lying in Bertie County aforesaid bounded by Mr Thomas PAGES land on the north by Mr VACANTS? VANN? land on the east by Mr Thomas PAGES aforesaid west and south with all buildings and workmanship thereon all proffits priviledges and advantages thereto belonging to  have and to hold the said dold land proffits and priviledges to him the said John MORRIS to the only proper use and behoof of him the said John MORRIS and his assigns forever and in default of such assigns tothe only proper use and behoof of the heir of the body of the said John MORRIS and at their assigns forever/each in posession having hereby full power to assign or to any person or persons all or any part or parts of the said land proffits priviledges and on the death or extinction of all such issue heirs then the said lands proffits and priviledges or so much thereof or then shall not happen to have been assigned over by the said John MORRIS or the heir of his body to the said James MORRIS to the only proper use and behoof of the said James MORRIS his leagaly nominated represenatative or represenatatives their heirs and assigns forever and in default of such nomination of the death of the said John MORRIS thento the heirs of the said John MORRIS to the only proper use and behoof of the  __? at law of the said John MORRIS their heir and assign forever and the said Aaron ELLIS covenants with the sd John MORRIS and James MORRIS that the the sd Aaron ELLIs hath a legally right to sell the said land proffits and privedges and that and that the whole and every part thereof shall forever remain to the said John MORRIS and James MORRIS and the several heris and assigns the manner above described  free and clear from all former sale, grants bargains, mortgages and demand whatsoever  ___? dowers exception and excepting quitrents and all leases and damages on account of quitrents .In witness where of the parties have hereunto set their hands and seal on the year and day above written --Aaron ELLIS and his seale.
