Bertie COUNTY Freeman,Wm to Morris,James-1760 File contributed for use in USGenWeb Archives by Cathy Farris cfassir@netdex.com K397 William FREEMAN to James MORRIS 1760 Bertie Co This indenture made this twenty fourth day of December 1764 between William FREEMAN of Norfolk in Virginia and Tabitha his wife of the one part and James MORRIS late of Newcastle Court, Butcher Row in London in Great Britain of the other part - Witnesseth, that the said William FREEMAN and Tabitha his wife for and in consideration of the sum of one hundred and forty two pounds ten shillings sterling lawfull money of Great Brittain to him the said FREEMAN in hand paid at and before the sealing and delivery of these presents the receipt whereof he the said William FREEMAN and Tabitha his wife do hereby joyntly and severaly acknowledge of thereof and of every part thereof do hereby acquit, exonerate and discharge him the said James MORRIS his heirs Exor Adm and assigns. have given, granted, bargained and sold and by these presents do joyntly and severaly give, grant bargain and sell unto him the said James MORRIS his heirs as assisgns forever a piece or parcel of land situate lying and being in Bertie county in the Province of North Carolina, being by computation five hundred and twenty two ac or thereabouts, being part of five hundred and forty five ac, which five hundred and forty five ac begin at the mouth of a branch comeing out of Flag Run, the division line of William VANN, then up the said branch to the head, thence along a line traced to a pine at William VAANS corner in the patent of David HARRELL, thence along the siad lin to the center of two pines and a red oak thence along David HARRELL's line to a pine David HARRELLS corner thence along a line of marked trees to George HOUSE's cornner, thence along HOUSES line to Widow BRYAN's line, then along her line to a corner tree, formerly STEVENS corner, thence along a line Aaron ELLIS to a corner three trees, Ellis HOGES corner, thence along HOGES line to three hickorys on Flag Run thence along HOGES line to John HARRELL line thence down John HARRALLS line to Flag RUN thence up Flag Run to the first station. The remaining twenty three ac whereof were sold to one HAROLD, then of the Uneroy Marshes in Bertie County. to have and to hold the said lands with all woods, underwood ways, water courses, gardens, buildings, mines except one half or one quarter of gold and silver mines claimed by the King or Lord Proprietor/priviledges, comodity's, mortgages and appurtenances whatsoever these unto belonging to him the said James MORRIS his heirs and assigns forever, and to hs and their only proper use and benefit forever. And the said William FREEMAN and Tabitha his wife for themselves and each of them their heirs Exor Adm and assigns do hereby joyntly and several covenant promise grante and agree to and with him the said James MORRIS his heirss and assigns that he the said William FREEMAN at the time of sealing and delivery these presents, hath in himself, good right full power and lawfull authority, do give grant, bargain and sale the said land and appurtenances unto him the said James MORRIS his heirs and assigns in manner and form aforesaid and that the said lands, buildings priviledges, advantage and appurtenances, now are and shall forever after remain unto him the said James MORRIS his heirs and assigns free and clear and freely and clearly exonerated andd discharged of and from all former gifts grants bargains sales leases wills bonds judgments and all former incumbrances whatsoever and tht he the said William FREEMAN and Tabitah his wife, their and each of their heirs EX and Ad and Assign shall and will allways and at all times extend the said James MORRIS his heirs and assign forever in quiet prosession of the whole bargain premises and the said William FREEMAN and Tabitha his wife do hereby covenant and agree with the said James MORRIS his heirs and assigns, that his the said William FREEMAN and Tabitha his wife and their and each of their heirs Ex ADM and assigns shall and will at the reasonable request of him the said James MORRIS his heirs or assigns procure any proper deed from the former propriato ror proprietors their heirs or assigns and shall and will at any time or times hereafter at the reasons charges of the said james MORRIS his heir and assigns make do acknowledge and execute all and every other act and acts, deed and deeds conveyance and conveyances for the better securing the right the said James MORRIS his heirs and assigns to the said five hundred twenty two ac of land and the building and appurtenances, thereto belonging and the said James MORRIS doth hereby convnant for himself his heirs and assigns that he or they shall and will pay to the Lord Proprietor or other proper person the annualle quitrents due henceforth for the said lands bargained for, He the said FREEMAN and Tabitha his wife their and each of their heirs Exe & Adm and assigns clearing the said lands to the day of the date hereof from all demands of the Lord Proprietor and every other person. In witness whereof each party hath in Norfolk aforsaid this said twenty fourth dayof December one thousand seven hundren and sixty three hath set his hand and her hand and seal in the presence of three credible witnesses. James MORRIS 1763 December 24th: Then received of James MORRIS the sum of one hundred and forty two pounds sterling being the consideration money within mentioned received also the remaining ten shillings by us, Wm FREEMAN, Tabitha FREEMAN, witness, Mathew ROTHERY, Paul WATLINGTON Bertie County in North Carolina, I William FREEMAN do acknowledge to have t ohave signed sealed and delivered this deed and to have received the consideration money on the day of the date of the deed in the presence of the subscribing witnesses as witness my hand seal and second deliver, this twenty ninth day of Decmeber 1763 William FREEMAN seal Witness.
