Transcribed by Lisagraham32@aol.com BOOK E Page 52 Hatcher To Wimberly To all people to whom these presents shall come, greeting: Know Ye, That I, John Hatcher of Edgecombe in the County of Albermale, within his Majestys Province of North Carolina, planter, for and inconsideration of the sum of forty pounds, province bills of North Carolina in hand before the ensealing hereof, well and truly paid by Thomas Wimberly of the County aforesaid in Bertie Precinct, the receipt whereof I do hereby acknowledge myself thereunto fully satisfied, contented and paid thereof and of every part and parcel thereof, and do exonerate, acquit and discharge the said Thomas Wimberly, his heirs, executors, administrators, forever by these presents, have given, granted, bargained, sold, alienated, conveyed and confirmed unto him, the said Thomas Wimberly, his heirs and assigns forever, one certain messuage or tract of land and plantation situate, lying and being in Bertie, in the County aforesaid containing, by estimation five hundred and seventy nine acres of land and plantation; it being a Patent formerly granted to Edward Moore. July 20th Day 1717 butted and bounded as followeth : beginning at a marked pine, Martin Gardner's Corner tree on South West side of Cashy Swamp; thence South forty degrees, West three hundred and twenty pole to a white oak; thence south fifty degrees East, three hundred and twenty pole to a pine; thence South fifty degrees East two hundred and sixty six pole to a pine on Cashy Swamp; Thence the Meanders of the swamp to the first station. To have and to hold the said granted and bargained premises with all the appurtenances, privileges, commodities to the same belonging, or in any wise assertaining to him, the said Thomas Wimberly, his heirs and assigns forever, to his & their only proper use and benefit and behalf forever, and the said John Hatcher, for me, my heirs, executors, administrators, do covenant and grant to and with the said Thomas Wimberly, his heirs and assigns that before the ensealing hereof I am the true sole and lawful owner of the above bargained premises, and am lawfully seized and possessed of the same in my own proper right as a good perfect and absolute estate of inheritance in fee simple and have in my self a good right full power and lawful authority to grant, bargain, sell, convey, and confirm, the said bargained premises in manner as above said, and said Thomas Wimberly his heirs and assigns shall and may from time to time and at all times, forever hereafter by force and virtue of these presents, lawfully, peaceably and quietly have, hold, use, occupy, possess and enjoy the said demised and bargained premises with the appurtenances free and clear and freely and clearly acquitted, exonerated and discharged of from all and all manner of former and other gifts, grants, bargains, sales, leases, mortgages, wills, entails, payments, dowries, judgments, executers, incumbances and extents: Furthermore I, the said John Hatcher, for myself, my heirs, executors and administrators do covenant and engage that the above demised premises to him, the said Thomas Wimberly, his heirs and assigns against the lawful claims of any person or persons whatsoever forever hereafter to warrant secure and depend and Dorithy, the wife of me, the said John Hatcher doth by these presents freely willing, give, yield up and surrender all her right of Dowry and power of this as of in and unto the above demised premises unto him the said Thos. Wimberly, his heirs and assigns. In witness whereof I have here unto set my hand & fix my seal this second day of February 1736.
