BERTIE COUNTY Deeds Hodges,Elias to Pugh,Thomas-1761 File contributed for use in USGenWeb Archives by Cathy Farris cfassir@netdex.com K67 Elias HODGES to Thomas PUGH 1761 Bertie Co this Indenture the second day of January in the year of our Lord One thousand seven hundred and sixty one, between Elias HODGES of the county of Beaufort in the Province aforsaid of the one part and Thomas PUGH of the county of Bertie in the said Province of the other part. witnesseth, that the sd Elias HODGES for and in considertion of the sum of two hundred and sixty eight pounds current money of the colony of Virginia to him in hand paid at on or before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged and the said Elias HODGES he the said Thomas PUGH doth hereby acquit and discharge hath bargained, sold, released and confirmed and by these presents doth fully freely and absolutely, grant, bargain, sell, release and confirm unto the said Thomas PUGH his heirs and assigns forever and tract of land and Plantation situate lying and being in the county of Bertie aforesaid containing by estimation three hundred and eighty acres of land be the same more or less, beginning at the mouth of a small branch on Rockquis, thence runing up the branch to Samuel HERRINS line thence along the said HERRINS line to the corner a red oak then N75W212 pole the center of three hickorys in the Flag Branch then S0W200 pole to a sweet gum red oak and white oak then S75 E96 pole to a gum on Rockquis, thence along Rockquis to the first station, which said tract of land was by the last will and testament of Robert HODGES given to his daughter Sarah CAINE and by the said Sarah CAINE and John CAIN her husband conveyed to the said Elias HODGES, by deed bearing date the 22 day of December in 1753. together with all houses, orchards and building thereon, and all his right title and interest in and to the said premises and the reversion and reversions remainder and remainders, rents, __?, and profits theseof and every part and parcel thereof with the appurtenances. To have and to hold the said tract of land with all edefices, profits, priviledges, hereditaments and appurtenances to the same belonging to the said Thomas PUGH his heirs and assigns forever he or they paying quitrents for the same, and the said Elias HODGES for himself his heirs EXE's and Adm's doth covenant, promise and agree to and with the said Thomas PUGH his heirs and assigns that the above granted premises except forty foot square where the graveyard is are free and clear of all charges and incumbrances whatsoever, and that the said Elias HODGES hath an indefesable Estate of Inheritance in fee simple in and to the said premises and hath full power and authority to sell and dispose of the same, and the said Elias HODGES his heirs Exor and Adm shall and will warrant, secure and forever defend the same to the said Thomas PUGH his heirs and assigns forever against the lawfull claim or demand of any person or persons whatsoever and shall and will at anytime hereafter on the reasonable request of the said Thomas PUGH, make and execute such other conveyance in the law for the better confirming or sure making the said premises to the said Thomas PUGH his heirs or assigns as shall be divised or required .In witness whereof the said Elias HODGES hath hereunto set his hand of seal the day and year above written.
