All rights reserved. http://www.usgwarchives.net/copyright.htm File contributed for use in USGenWeb Archives by JGH900@aol.com Jim Holder http://www.usgwarchives.net/nc/bertie.htm Deed from Thomas Holder & James Holder to Elisha Holder Deed dated August 19, 1796 Deed Book R, Pages 217/8 Deed recorded November Term 1796 "To all People to whom these presents shall come Greeting, Know ye that I THOMAS HOLDER & JAMES HOLDER of Bertie County and State of North Carolina for and in consideration of the sum of Forty two pounds Ten shillings current money of the state to us in hand paid before the ensealing hereof by ELISHA HOLDER of the state and county aforesaid, the receipt whereof we do hereby acknowledge and ourselves therewith fully satisfied and contented and thereof and of every part and parcel thereof do exonerate acquit and discharge the said ELISHA HOLDER his heirs executors and administrators forever by these presents have given granted bargained sold aliened conveyed and confirmed and by these presents do freely and absolutely give grant bargain sell alien convey and confirm unto him the said ELISHA HOLDER his heirs and assigns forever all the wright and title that we have to one messuage or tract of land situate lying and being in Bertie County aforesaid containing by estimation one hundred sixty five acres more or less lying on the north side of Cashy Swamp, Beginning in Cashy Swamp at the mouth of Poplar Branch running up the said branch to which JAMES TAYLOE's and DAVID PRUDEN's line to JAMES WILSON's line then along his line to Cashy Swamp and from there down the various courses of the run of the said Swamp to the first station containing by estimation one hundred and sixty five acres bee the same more or less, To have and to hold the said granted and bargained premises with all the appertenances priviledges and commodities to the same belonging or in any wise appurtaining to him the said ELISHA HOLDER his heirs and assigns forever to his and their only proper use benefit and behoof forever and we the said THOMAS HOLDER and JAMES HOLDER for we our heirs executor administrators do covenant promise and grant to and with the said ELISHA HOLDER his heirs and assigns that before the ensealing hereof we are the true sole and lawfull owners of the above bargained premises and are lawfully seized and possesed of the same in our own proper right as a good perfect and absolute Estate of Inheritance in fee simple and have in ourselves good right full power and lawfull authority to grant bargain sell convey and confirm the said bargained premises in manner as abovesaid and that the said ELISHA HOLDER his heirs and assigns shall and may from time to time and at all times forever hereafter by force and virtue of these presents, lawfully peaceably and quietly have hold use occupy possess and enjoy the said demised & bargained premises with the appertinances free and clear, and freely and clearly acquited exonerated and discharged of and from all manner of former and other gifts grants bargains sales leases mortgages wills intails jointers dowries judgments executions incumberances and extents, Furthermore we the said THOMAS and JAMES HOLDER for ourselves our heirs executors administrators do covenant and engage the above demised premises to him the said ELISHA HOLDER his heirs and assigns against the lawfull claims or demands of any person or persons whatsoever forever hereafter to warrant the secure and defend.
