M, p.244-245 North Carolina Bertie County This Indenture made the first day of April in the Tenth year of our Sovereign Lord King George the third & in the year of our Lord Christ One Thousand Seven Hundred Seventy Five, Between Caleb HOOTEN of Bertie County in the Province of North Carolina of the one part & John WESTON of the County & Province affords. of the other part Witnesseth that for & in consideration of the sum of Eighty four pounds proclamation money by the said John WESTON to the sd Caleb HOOTEN in hand paid the receipt whereof is hereby acknowledged be the sd. Caleb HOOTEN for himself & his heirs hath Granted. Bargained sold aliened Enfeoffed & set over & by the presents doth Grant Bargain see alien enfeoff & set over unto the said John WESTON his Heirs & assigns all that piece parcel or Tract of Land Lying & being in Bertie County in the Province aforesd. on Salmon Creek containing by Estimation Fifty acres Butted & Bounded as follows: Beginning at a poplar at the head of the Spring Branch then running down the Branch to Corner tree on RYAN’S line then running a South West course Bounded on RYAN’S line to a Hickory a corner tree then North West Course Bounded on John DAVISES line whereon Ann SHAW now lives to a Corner tree then Bound on William ASHLEY’S line & from thence to the first station. To have & to hold the afresh. fifty acres of Land with the appurtenances & all rights privileges & improvements to the same in anywise belonging to him the said John WESTON his heirs & assigns forever & the sd. Caleb HOOTEN for himself & his heirs doth hereby covenantally & agree to & with the said John WESTON his heirs & assigns that he the sd. Caleb HOOTEN hath full power & authority to sell convey & make over the aforesd. Granted Land & premises for ever & further that he the said John WESTON his heirs & assigns shall & may forever hereafter peaceably quietly have hold occupy possess & enjoy the afore granted Land & premises without the let? or molestation of all or any persons whatsoever & free & clear from all manner of former or other encumbrances whatsoever & the sd. Caleb HOOTEN doth oblige himself his heirs Exrs. & Admr’s to warrant & defend the afore granted Land and Premises & every part & parcel thereof to him the sd. John WESTON his heirs & assigns & all persons Lawfully Claiming or to Claim by from or under him or them or any of them and from and against all & all manner of persons whose now lawfully or hereafter lawfully may Claim the sd. land & premises or any part or parcel thereof and Ann HOOTEN the wife of me the sd. Caleb HOOTEN doth by these presents freely willing give yield up & surrender all her right of Inheritance, right of Dowry & power of thirds of & to the above devised premises unto him the sd.
