M, p. 663-664 North Carolina Bertie County This Indenture made this Twenty fifth day of February 1784 Between Caleb HOOTEN of the County of Bertie in the province aforesaid of the one part and James BURN of the other part. Witnesseth that for and in consideration of the Sum of One hundred and fifty pounds proclamation money by the sd. James BURN tot he sd. Caleb HOOTEN in hand from the Receipt whereof is hereby fully acknowledged one the sd. Caleb HOOTEN for himself & his heirs hath granted Bargained & Sold Aliened Enforsed & Set over him the said James BURN his Heirs & assigns one certain piece or parcel or tract of Land Containing Two Hundred acres more or less Situate lying & being in the County & province aforesaid & on the West side of the Easternmost Swamp of Salmon Creek and bounded as follows Viz: Beginning at the mouths of a Branch known by the name of the Cross Branch thence running up the side of the sd. Branch to Cullen POLLOCK’S line thence along said line about a South course to a Pine Jesse HARDYS & Samuel WILLIAMS line thence along sd. WILLIAMS line to a parcel sd. Easternmost Swamps to the first Station it being a parcel or tract of Land formerly belonging to Benjamin HARDY the bounds will more fully appear in a deed from the sd. HARDY to John SMITH to whom the sd. HARDY sold it to John SMITH to Moses TODD. To have and to hold the sd. Tract of Land with the appurtenances & all rights privileges & Improvements to the same in anywise belonging to him the sd. James BURN his Heirs or assigns forever and the sd. Caleb HOOTEN hath full forever & authority to sell and convey & make over the aforesd. granted land & premises forever & further that he the sd. James BURN his Heirs & assigns shall and may forever hereafter peaceably & Quietly have Sold occupy possess enjoy the aforesd. granted land & premises without the let or Molestation of or any person whatsoever free & clear from all & all manner of forever or others Incumbrances whatsoever and the said Caleb HOOTEN doth oblige himself his Heirs Executors Admrs. to Warrant & defend the aforesd. granted Lands & premises & every part and parcel thereof to him the said James BURN his Heirs and assigns and all persons Lawfully claiming or to claim by from or under him or them or any of them and from & against all manner of persons who now Lawfully claim or hereafter may Lawfully claim the said Land and premisses or any part of parcel thereof.
