File contributed for use in USGenWeb Archives by Lorene Rambo hocott@aol.com ========================= Edward and Elizabeth HOWCOTT to John HOWCOTT (brother) Deeds of Bertie County, Book E, p. 367 Sept. 26, 1737 North Carolina To all people to whom these presents shall come Edward Howcott and Elizabeth his wife of Bertie Precinct sends Greeting-- Know ye that I the said Edward Howcott for and in consideration of Piece of Land in Exchange from my brother John Howcott of Bertie Precinct Yeoman Have bargained Sold and Exchanged and by these presents do fully freely clearly and absolutely give grant bargain sell alien Enforsse release convey and Confirm assign Transfer and Set over unto him the said John Howcott his heirs and assigns forever a certain Plantation and parcel of land Situate lying and being in Bertie precinct aforesaid Containing by estimation forty acres (be the same more or less) bounded thus viz. beginning at a white oak upon Vixes Branch thence down Vixes Branch to the mouth of it thence up Sandy Run to a Hickory thence along William Williamsons Land Line to the first station. To have and to hold the said Plantation and parcel of Land and all and singular the rights and privileges commodities profits advantages Hereditaments appurtenances appendants thereto belonging or any wise appertaining unto the said John Howcott his assigns and heirs forever in fee simple absolutely to the only use and behoof of him and them forever in as full and ample manner to all Intents whatsoever and as the most learned in the Law Can Devise. Further I the said Edward Howcott for myself, my heirs executors and administrators do Covenant and Engage to and with the said John Howcott his heirs and assigns forever to warrent and forever Defend the said Plantation and Parcel of Land with its appurtenances free from all Encumbrances whatsoever except accruing Quit rents against all claims whatsoever. And Elizabeth Howcott wife of the said Edward Howcott Doth by these presents freely and willingly give yield up and surrender all her Right of Dowrie . . . unto the said Plantation Lands and Premises unto the said John Howcott his heirs and assigns forever. In Witness whereof we the said Edward Howcott and Elizabeth Howcott Have hereunto set our Hands and Seals this 26 day of Sept. Anno Dom. 1737. Sealed and Delivered in the presence of Jno. Wynns, Wm. M. Rogers, Richard R. Williamson. Bertie Precinct Nov. Ct. 1738. The aforementioned Deed of sale was duly Proved in open court by the oath of John Wynns a subscribing witness thereto which on motion is ordered to be Registered.
