Bertie County NC Deed Book Bird Hubbard to Jesse Jones - 1792 File contributed for use in USGenWeb Archives by Will Cooper wcooper@cot.net http://files.usgwarchives.net/nc/bertie/deeds/hubbard.txt Bertie County, NC Deed Book P p. 381-382 Indenture - Bird Hubbard to Jesse Jones Bertie County NC 27 August 1792 Hubbard } This Indenture made the 27th day of August, Between to } Bird Hubbard of the County of Bertie in the state of North Jones } Carolina of the one part, and Jesse Jones of the County and State aforesaid of the other part witnesseth; That for and in consideration of the Rent & covenant hereinafter Reserved & Contained on the part & behalf of the said Jesse Jones Exors. & admns. to be paid Kept & performed he the said Bird Hubbard hath Devised granted & to farm lets unto the said Jesse Jones all that Messuage or Tenement or plantation formally the property of George Ward situate as follows, Bounded on one side on Joseph Jordans line from thence all within the Branches surrounding the said plantation the said Jesse Jones hath Liberty to cut and clear all the the Lands within said Bounds & to cut Rale Timber Firewood or Board Timber on any other part of said Lands most convenient for the use of said plantation with all and singular the profits Comodities & appurtenances to the said Messuage or Tenement belonging or appertaining. To have and to hold the said Messuage or Tenement & all & singular the premises with their and every of their appurtenances herein before mentioned to be hereby devised unto the said Jesse Jones his Exors. Admns. & assigns for and during and unto the full end & Term of seven years from the first day of January next ensueing & fully to be completed & ended Yeilding & paying therefore yearly & every year during the said Term unto the said Bird Hubbard his heirs Exors. Admns. or assigns the Rent or sum of eight Barrells of corn per year for & during the Term above mentioned & the said Jesse Jones for himself his Exors. Admns. & assigns doth covenant & grant to and with the said Bird Hubbard his Exors. Admns, or assigns the said yearly rent or sum of eight Barrells of corn on the day and times & in manner & form above mentioned for payment of the same according to the Reservation thereof as aforesaid & the true intent & meaning of these presents & also that the said Jesse Jones his Exors. Admns. & assigns or some one of them will and shall at his or their own proper costs & charges well & sufficiently Repair uphold support maintain & Keep the said Messuage or Tenements & premises with all & all manner of needful Repairation and amendments whatsoever when and as often as need & occasion shall be need during the time the casuality of fire or Tempest which may destroy the said Messuage or Tenement and premises or any part thereof only Excepted and the said Messuage or Tenement or premises being so well and sufficiently Repaired upheld supported maintained & Kept at the end of the said Term and the said Bird Hubbard for himself his Exors. Admns. & assigns doth covenant and grant to and with the said Jesse Jones his Exors. Admns. & assigns paying the said yearly rent of eight barrells of corn above reserved in manner aforesaid & performing all and every the Covenants & agreements herein before contained which on his or their parts and behalfs are or aught to be paid done and performed shall & may peacably and quietly have hold use occupy possess and enjoy the said Messuage or Tenement and premises hereby Devised for and During the Term hereby granted without any lawful let suit Trouble or interruption of or by the said Bird Hubbard his Exors. Admns. & assigns or any of them or by any other person or persons Lawfully Claiming or to Claim by from or under him them or any of them or by or through his their or any of their acts means or procurements.
