W. Mitchell and wife, Laura E. Mitchell to S. S. Cowand** This Indenture made the first day of Feby 1906, by J. W. Mitchell and Laura E. Mitchell his wife of Bertie County and State of North Carolina of the first part to S. S. Cowand of Bertie County and State of North Carolina, of the second part: Witnesseth, That said J. W. Mitchell and Laura E. Mitchell in consideration of the sum of Ninety dollars to them paid by S. S. Cowand the receipt of which is hereby acknowledged, have bargained and sold and by these presents do bargain, sell and convey to said S. S. Cowan his heirs a certain tract or parcel of land in Bertie County, State of North Carolina, adjoining the lands of S. S. Cowan and others, bounded as follows viz: Beginning at a stake near intersection of J. W. Mitchell's path and the public road, thence along side of public road N. 34 1/2 E. 88 yards, then N. 20 3/4 E. 52 yards to a stake on side of road, thence N. 54 1/2 W. 135 yards to a stake (a corner) thence S. 33 W. 140 yards to a stake ( a corner) near J. W. Mitchell's path, thence near path S. 56 E. 140 yards to the first station containing by survey (4) four acres. To have and to hold the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging to the said S. S. Cowan his heirs and assigns to his and their only use and behoof forever. And the said J. W. Mitchell and Laura E. Mitchell covenants with said S. S. Cowan his heirs and assigns that they are seized of said premises in fee and have the right to convey the same in fee simple; that the same are clear from all incumbrances, and that they will warrant and defend the said title to the same against the claims of all persons whomsoever. In testimony whereof the said J. W. Mitchell and Laura E. Mitchell have hereunto set their hands and seals the day and year above written. J. W. Mitchell (seal) L. E. Mitchell (seal) Witness: M. T. Phelps. North Carolina, Bertie County. I, M. T. Phelps, do hereby certify that J. W. Mitchell, and Laura E. Mitchell his wife, personally appeared before me this day and acknowledged the due execution of the annexed conveyance; and the said Laura E. Mitchell being by me privately examined separate and apart form her said husband, touching her voluntary execution of the same doth state that she signed the same freely and voluntarily, without fear or compilsion of her said husband or of any other person, and that she doth still voluntarily assent thereto. Phelps who was at the time of signing same, a Justice of the Peace of Bertie County, is adjudged to be correct. Let the instrument, with the certificates be registered.
