Moore, of the first part and Charles J. Moore, of the second part, both of the above State and County, witnefses, that whereas the said Charles S. Moore is indebted to Eliza Waterman of the above State and County, in the sum of Eight Hundred and Forty Eight and 33/100 dollars, bearing interest from July 13, 1861, bearing even date with these presents, as will more fully appear by a note; and whereas the said Charles S. Moore is desirous to secure the payment of the aforesaid debt with interest: Now, therefore, this Indenture witnefses that, for and in consideration of the premises, and for the further consideration of five dollars to him, the said Charles S. Moore, this day in hand paid by the said Charles J. Moore, the receipt in full of which is hereby acknowledged, he, the said Charles S. Moore, hath this day granted, bargained, sold, aliened and conveyed, and does hereby grant, bargain, sell, alien, and convey unto him, the said Charles J. Moore, his heirs and assigns, the following property, to wit: A tract of land situated in Bertie County, containing one hundred & ten acres, more or lefs, and adjoining the land of Wm A. Ferguson, Starkey Bynum, John A. Moore and C. J. Moore, being a part of what is known as the Williams Tract of land; two horses, one rockaway and harnefs, one buggy harnefs, all his stock of cattle and hogs, one lighter, all his growing crops of every description, all his household and kitchen furniture, about one hundred and fifty thousand bricks and about five hundred cords of wood: to have and to hold unto him the said Charles J. Moore, his heirs and assigns forever: In trust and confidence neverthelefs, that if the said Charles S. Moore shall pay to the said Elisa Waterman the whole amount of the aforesaid debt with interest accrued thereon, on or before the 13th day of July 1863, then the said Charles J. Moore, Trustee, shall reconvey to the said Charles S. Moore, all the property herein conveyed. But if the said Charles S. Moore shall fail to pay to the said Elija Waterman, the whole amount of the aforesaid debt with interest accrued by the day specified, then at any day thereafter the said Charles J. Moore, Trustee, shall upon request of said Eliza Waterman, sell at public or private sale, the whole of the property herein conveyed, or so much thereof as may be necefsary to pay the above debt & interest due to said Eliza Waterman, and with the proceeds of said sale, shall first pay the debt due said Eliza Waterman, with all interest accrued thereon, and shall pay over to the said Charles S. Moore any surplus that may remain in his hands and shall also reconvey to the said Charles S. Moore any property that may remain in his hands as Trustee.
