King Defender of the faith and so forth and in the year of our Lord Christ one thousand seven hundred and sixty five. Between James MORRIS the father of FLAG RUN Chapple in Berte County and Province of North Carolina in Brittish America of the one part and John MORRIS the son of the said Chappel, Province and county of the other part Witnesseth that he the said James MORRIS for and in consideration of the love and affection which he hath and beareth unto the said John MORRIS, hath given, granted aliened ensealled and confirmed and by these presents doth give, grant, aliene enseall and confirm unto the said John MORRIS (wheather he be or be not the real son) and his assigned forever, and on default of assigns to the heirs of body of the said John MORRIS and their assigns forever all at messuage or tenement whereon the said James MORRIS now dwelleth with about four hundred and forty ac more or less of land in Bertie County aforesaid about the said dwelling place and thereto belonging about one hundred and fourtee ac whereof are held by new patent ___? being the major part of what were granted to Needham BRYAN Esq the seventh day of Feb in the year one thousand seven hundred and fifty four the remaining three hundred and twenty odd? acres being also the major part of what were granted by an old patent( and now held by that tenure) dated the first day of February in the year one thousand and seven hundred and twenty five to George STEVINSON which land by virtue of Sunday/Sundry? legal sales do now of right belong to the said MORRIS and is bound as follow to wit. By George HOUSE Esq's land, one the East by Mr Aaron ELLIS on the south East and also on the NE by Thomas PUGH Esq's land on the south by Mr David HARRILLS on the SW as also by Mr William VANN on the SW by Mr Peter SMITHS and Mr Jonah HARRELLs land on the West and by Mr Jesse HARRILLS onthe north and the old patent land meets the new patent land in the north and the new patent land has also a narrow slip on the north east of the old patent line all the divisions being marked by the several of marked trees/ To have and to hold the said four hundred and forty acres of land with a buildings and for use thereon and all proffit,priviledges and advantages by virtue of the said patents thereto belonging to him the said John MORRIS and his assigns and in default of such assigns to the heirs of his body and there assigns to the only proper use and behoof of him the said John MORRIS and his assigns forever and in default of such assigns for all or part thereof thenall or so much thereof as shall not be assigned ever by the said John MORRIS to the only proper use and behoof of the heirs of the body of the said John MORRIS from generation to generation and their assigns forever, each such bodily heir being in possession haveing hereby full power to assign the whole or part or parts thereof to any other person or persons forever and the said James MORRIS covenants with the said John MORRIS that all these granted lands and buildings thereon with all proffits, priviledges and advantages thereto belonging shall forever remain unto the said John MORRIS and his assigns and in default of such assignes to the heirs of the body of the said John MORRIS their assigns forever clear and discharged form sale former grants, sales, mortgages, bargains and demands whatsoever, warrrent dowereies and quitrents only excepted and the said James MORRIS covenants with the said John MORRIS that the said James MORRIS shall pay or cause to be paid to the sia John MORRIS at the age of thirteen years but to no other person or persons whatsoever except the heirs of his body all the rents and proffits of the said lands from the date hereof to the time of his being__teen years old towards setling up the said John MORRIS in some trade or business that is to say the said rents and proffits of the said land and buildings after the division of all future reasonable repairs for so long atime as the said James MORRIS shall live and recieved the same by himself or order? between the date hereof and the time the said John MORRIS shall be thriteen years old. Provided never the less and it is hereby provided that if it should happen that the said John MORRIS and all the heirs of the body of any should be dead and extinct at atime when all or part of the hereby granted alnd remin unassigned over to any person or persons whatsoever by the said John MORRIS or __? heirs of his body then the whole or unassigned parts of the hereby granted land shall revert with all proffits priviledges and advantages thereto appertaining to the said James MORRIS and to such person or persons as the said James MORRIS shall by will or deed nominate these to there heirs and assings forever and it is hereby farther provided that neither the said James MORRIS or his heirs exe and Adm or other persons or person on the said James MORRIS Accounts shall be liable to or make good to the said John MORRIS his heirs Exe and Adm or other person or persons on his account any damages or leases in regard to the said new patent land that may or shall be sustained on account of the quit rents possessed? present or to come __? on account of any want of any tenants to the said land nor on account of any failure of presents paying the rents or performing their covenants and the said James MORRIS farther forever with the said John MORRIS shall be thirteen years old shall not be deducted from the rents or proffits of the hereby granted lands that the sai John MORRIS shall not be accountable for the same nor have any demands on those accounts in any shape whatsover for so long atime from the date hereof as the said James MORRIS shall live till the thirteenth year of the said John MORRIS age shall be fulfilled. In witness whereof the said James MORRIS hath in the presence of lawfull witnessees on the year and day above written toped his seal and set his hand hereto and delivered this deed in legal form James MORRIS being allowed to enjoy the premises rent free for four monthe from the date thereof: James MORRIS Witnesses to the signing sealing and delivery hereof are we: William JUNKISON, Needham BRYAN in open court March 1765 note: was this boy his real son?
