BERTIE COUNTY Deed - Perry, Hymerick - File contributed for use in USGenWeb Archives by TRS0304@aol.com Hymerick Perry's Will The following will is transcribed to the best of my abilities. Where I cannot make out a word, I will place an (sp) in that space. A copy of this will was sent to me after inquiry about the HALSEY surname. Hymerick Perry's Will I Hymerick Perry of the County of Bertie and State of North Carolina, being of sound mind and memory but considering the uncertainity of my earthly existence, do make and declare this my last will and testament in manner of form following that is to say. first. That my Executor hereinafter named shall provide for my body a decent burial, suitable to the wishes of my relatives and friends and pay all funeral expenses, together with my just debts, however and to whomever owing out of the moneys that may first come into his hands as a part or parcel of my estate. Item. I give and devise to my son, John S. Perry that tract of land whereon I now live except the life estate of my wife devised in a firm item of this my will to have and to hold to him and his heirs in fee simple forever except thirty acres on the north side is to go in with the undivided land. Item. I have and devise to my son Joseph Perry fifty acres of land whereon he now lives to have and to hold to him and his heirs forever. Item. I give and devise to my Grandson Martin Van Buren Perry fifty acres of land whereon Martin Perry now lives to have and to hold to him and his heirs forever. Item. All the rest of my land to be equal divided between Abner Perry, Zachariah Perry, Nancy Perry, Sinthia Jerigan, Simon Perry-Lewis. Item. I give and devise to my grand daughter Melissa A. HALSEY twenty dollars to be paid by my executor. Item I give and bequeath to my said beloved wife all my household and kitchen furniture, during her life, also one cow & calf, first choice. Item My will and desire is that all the residue of my estate, if any, after taking out the devises and legacies above mentioned shall be sold and the debts owing to me collected and if there should be any surplus, over and above the payment of debt expenses and legacies that such surplus shall be equally divided and paid over to my said wife and all my children equally proportion shares and share alike to them and each and every of them, their executors, admiistrations and assigns absolutely forever. And lastly I do hereby trust my adminstrator whomever he may be to execute this my last will and testment according to the true intent and meaning of the devise and every part and clause thereof hereby revoking and declaring (sp) void all other wills and testaments by me heretofore made. In (sp) whereof I the said Hymerick Perry do hereunto set my hand and seal this the 17th of April 1856.
