Bertie County NC Deed Book Mary Phillaw Windsor Town Lot File contributed for use in USGenWeb Archives by Will Cooperwcooper@cot.net http://files.usgwarchives.net/nc/bertie/deeds/phillaw1783.txt Bertie County NC Deed Book M p. 742 Commissioners to Mary Phillaw Windsor, Bertie County NC 14 August 1783 North Carolina To all to whom these Presents Shall come We Zedekiah Stone Anthony Darlitt & Richard Dawson of the commissioners for the sale of lotts in Windsor send Greeting Know ye that we the said commissioners in Pursuance to an act of assembly passed at Newbern the third Day of November one thousand Seven hundred and Sixty Seven and by Virtue of the Power and authority thereby to us given & also for and in consideration of the sum of Two pounds five Shillings Lawfull money of the Said State to the aforesaid Commissioners for the said Town in hand paid the receipt whereof is hereby acknowledged have Granted Bargained Sold aliened assigned & Set over & by these presents do Grant Bargain Sell alien Set over and assign unto Mary Phillaw one Lott or half acre of ground being part of the said Lands containing in the Plan of the Said Town & are Known & distinguished by the number 46 To Have & to Hold the Said Lott or half acre of Land to the said Mary Phillaw her Heirs & assigns forever together with all rights Privileges & appurtenances thereunto Belonging with sufficient Estover(?) on the remaining part of the Lands belonging to the Said Town & not taken up by any other Person & also right of commonage & all other rights & benefits thereto Belonging and appertaining and we the said commissioners for our selves and Successors do covenant grant promise and agree to and with the said Mary Phillaw her Heirs and assigns in manner and form following that is to say that the said Mary Phillaw her Heirs and assigns shall and may peacably & quietly Have, Hold use occupy possess & Enjoy the afore mentioned lott with all and Singular the appurtenances thereto belonging without any manner of interuption Eviction or molestation of us the said commissioners and Successors or any of us or any other person whatsoever provided that if the said Mary Phillaw Her Heirs or assigns Shall Build erect or cause to be Built or Erected on the said Lott one Tenable House not of less dementions Sixteen feet Square without Sheds with a Brick chimney within Three years after the date of these presents and shall also clear the said lott from all woods underwoods Brush or grubs then this deed of grant Sale or conveyance to stand and be of full force & of her or their non performance of the past mentioned clauses in this deed the whole to be void & of non effect In Witness whereof we the said Commissioners have hereunto Set our Hands and Seals this fourteenth day of August A.D. one thousand Seven hundred and Eighty three Signed Sealed & Delivered in ye presence Zed.
