Coggin Deed of Trust This indenture made this day between James Rice, of the County of Bertie, and State of North Carolina, of the first part, and William G. Coggin of the County and State aforesaid, of the second part, witnesseth, that whereas the said James Rice is justly indebted to Winefred Coggin in the sum of one hundred and twenty five dollars & interest, and the said James Rice is honestly desirous of securing the payment of the same, together with all the interest that may hereafter accrue, now, therefore this indenture witnesseth that the said James Rice, for and in consideration of the premises, and for the further consideration of five dollars to him in hand paid by the said William G. Coggin, before the sealing and delivery of these presents, the said James Rice hath granted, bargained, sold and conveyed, and by these presents doth grant, bargain, sell and convey unto the said Wm. G. Coggin, his heirs and assigns forever, a tract of land, lying and being in the County of Bertie, bounded by the lands of Robt. R. Taylor, Nathan Myers, George Wynns and others, containing about two hundred acres more or less, together with all and singular appurtenances and improvements thereto belonging or in any wise appertaining: also, the following named property, to wit: all my hogs, Cattle, and William G. Coggin, his heirs, executors, and assigns forever; and the said James Rice, doth for himself, his heirs, executors administrators and assigns, warrant and defend the right and title of all the said property, to him, the said W. G. Coggin, against the claim or claims of any person or persons whatsoever: - In special trust and confidence nevertheless and it is the true intent and meaning of therse presents and parties, that if the said James Rice shall fail to pay and discharge the said debt to the said Winifred Coggin, mentioned above, and all the interest due thereon or may hereafter accrue by the first of January 1854 A D or whenever thereafter payment shall be required by the said Winifred Coggin her executors, administrator, or assigns, that then the said Wm. G. Coggin shall and may upon giving public notice twenty days sell at public auction the whole of the above conveyed property, both real and personal, or so much thereof as may be sufficient to pay off and discharge the above mentioned debt and the costs and charges attending this trust: - And the proceeds of such sale shall be applied by the said Wm. G. Coggin to the payment of said debt, and should any supplus remain, after satisfying the debt and costs of this trust, it shall be paid over to the said James Rice - or his heirs, executors, administrator or assigns: - And it is understood between the parties, to this instrument, that until the said Winifred Coggin shall authorize the sale of said property, according to the conditions of this trust, that the property aforesaid is to remain in the possession of James Rice and Wm.
