Britton Bertie County North Carolina Deed Book OO Pages 406-407 State of North Carolina Bertie County This Indenture made and entered into betwen Joseph B Ruffin & wife, Mary E Ruffin of the first part and John C. Britton of the second part, all of the aforesaid State & County Witnesseth that the said party of the first part for and in consideration of the sum of fifteen Hundred dollars to them paid in hand, the receipt of which is hereby acknowledged hath bargained sold and conveyed unto the said John C. Britton of the first part a certain parcel of land on which I now reside located in fork of the Windsor and Halifax roads at Powell's x roads, beginning at a pine tree on the Halifax road, and bounded North and East by J.C. Britton land West by James W Wynns land South by the Jenkins land and said to contain one acre more or less, to have and to hold unto him the said John C. Britton his heirs and assigns forever and the said Joseph B Ruffin and wife Mary E Ruffin of the first part do hereby covenant and agree that a perfect title in fee simple passes to him the! said John C Britton by this deed and we furthermore bind our heirs administrators and executors to warrant and forever defend the right and title of the above described land to the said John C Britton his heirs and assigns forever In Witness whereof we hereby set our hands and seals this Witness John W Wynns J B Ruffin (Seal) Mary E Ruffin (Seal) State of North Carolina Bertie County Probate Court To George N Green Justice of the Peace Whereas, John C. Britton hath produced a Deed of Conveyance, to him from J B Ruffin and Mary E Ruffin his wife, of a certain tract or parcel of land lying and being in the county of Bertie, in our State, and procured the same to be proved before me, Judge of Probate of said County, and it being represented to our said Court, that it is required by law, that Mary E Ruffin wife of the said J B Ruffin to be privately examined, as to her free consent in executing the said conveyance; know ye that reposing confidence in your prudence I have appointed you, and by these presents do give unto you full power and authority to take the privy examination of the said Mary E Ruffin concerning her free consent in executing the said conveyance, and therefore command you that at such certain day and place, as you shall think fit you go to the said Mary E Ruffin if she cannot conveniently come to you, and privily and apart from her husband, examine her whether she executed the said conveyance freely and of her own accord, and without fear or compulsion of her husband; and when you have taken this examination, you are to send the same, closed up, under your seal, together with this commission to our said Court of Probate. Gurley, Judge of Probate, of said County at office this 6 day of January A D 1872 Wm P Gurley Judge of Probate Personally appeared before me G N Green Justice of the Peace of Bertie County, Mary E Ruffin, wife of ______________and acknowledged the due execution of the annexed Deed of Conveyance, and the said Mary E Ruffin, being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarially, without fear of compulsion from her said husband, or any other other person, and that she doth still voluntarily assent thereto.
