Bertie COUNTY NC Deed Ruffin, Starkey to Justin Askew - 1840 File contributed for use in USGenWeb Archives by Lynn McCarthy Lcmccarthy@aol.com http://www.usgwarchives.net/nc/bertie.htm Bertie County North Carolina Deed Book EE Pages 537 - 539 Starkey Ruffin Deed of Trust To Justin Askew This Indenture made and entered into this 15 day of September in the year of our Lord Eighteen hundred & forty between Starkey Ruffin of the first part Justin Askew of the second & Britton & Thompson of the third part & all of the County of Bertie & State of No Carolina Witnesseth that whereas the said Starkey Ruffin is justly indebted unto the said Britton & Thompson on a note bearing date the 13th September 1840 in the sum of $61.23 interest from date & being desirous to secure to said Britton & Thompson the payment of the same without the trouble & espense of a warrant to obtain it; now this indenture Witnesseth that the said Starkey Ruffin for and in consideration of the sum of one dollar in hand paid by the said Justin Askew, the receipt whereof is hereby acknowledged hath granted bargained & sold and doth by these presents grant bargain & sell the following property (viz) my right to a tract of land which came into my possession by my marriage to Martha Willoford containing one hundred & thirteen acres more or less, joining the lands of Thos Page [ ? ]dell Jordan & Jno Fraim one bay horse seven head of cattle (ie, three cows, three calves & one yearling three feather beds, steds & furniture, fifteen head of hogs, one side board, one loom, two spinning wheels household & kitchen furniture one horse cart forty barrels corn & fifteen hundred pounds of fodder unto the said Justin Askew his heirs & assigns forever, upon the special confidence nevertheless that if said Starkey Ruffin doth fail to pay unto the said Britton & Thompson the aforesaid sum of sixty one dollars & twenty three cents & interest & cost attending this conveyance then and that case the said Justin Askew is hereby required and empowered and shall have lawful authority to sell to the highest bidder for ready money after giving twenty days notice by advertisement of the time & plac! e of said sale and out of the money arising therefrom pay unto the said Britton & Thompson the above sum of of sixty one dollars & twenty three cents & interest from the 1st Jany last (1840) and all cost attending this conveyance, and the ballance if any pay unto the said Starkey Ruffin, But in case the said Starkey Ruffin shall pay unto the said Britton & Thompson the aforesaid sum of $61.23 & int, & cost on or before the first day of January next (1841) or any time before a sale shall take place then and in that case the said Starkey Ruffin shall be vested in his aforesaid property again as though this instrument had never been made and lastly the said Justin Askew doth bind himself to perform & do all things herein required to do & perform to the best of his judgement, of the intent & meaning of this instrument in witness whereof the parties have hereunto set their hands & affixed their seals this day and year above written. his Starkey X Ruffin mark Signed sealed and Justin Askew acknowledged in the Britton & Thompson presence of wit John P Jordan R H Cox State of No Carolina Bertie County Sept. 16th 1840 This execution of the above Deed of Trust from Starkey Ruffin to Justin Askew was proved before me by the oath of Jno P Jordan on of the subscribing witnesses thereto.
