Know ye that I Caleb SPIVEY of Bartie County in the Province of North Carolina Planter for and in consideration of the sum of five £ current money of Virginia to me in hand paid before ensealing and delivery hereof by Jonathan SPIVEY of the county and Province aforsd. The receipt whereof Ido hereby acknowledge and myself therewith fully satisfied and contented and thereof and of every part and parcel thereof do exonerate, acquit and discharge the said Jonathan SPIVEY his heirs Exes and Adms forever by these presents have given, granted, bargained sold, alienated, conveyed and confirmed and by these presents do fully freely and absolutely give, grant, bargain, sell, alien, convey and confirm unto the sd Jonathan SPIVEY his heirs and assigns forever one certain messuage and tract of land situate lying and being in the county aforesaid containing one hundred and twenty eight acres more or less butted and bounded beginning at Cashy Swamp a the mouth of a great branch called RONELLS? Branch thence up the Branch to the turn of the Branch, thence a the patten bearing date the first day of June 1725. Thence a strate corse down the sunay? to the main swamp and thence up the swamp to the first station. To have and to hold, the aid grant and bargained premise with all the appurtance, privileges and commodites to the same belonging or in any wise appertaining to him the said Jonathan SPIVEY his heirs and assign forever to his and these only and proper use, benefit and behoof forver and the said Caleb SPIVEY for me my heirs, Exes, Adms do covnant, promise? __? t oand with the said Jonathan SPIVEY his heirs and assigns that berfore the ensealing hereof I am the true sold and lawful owner of the above bargained, premise and am lawfully seized and possessed of the same in mine own proper right do a good, perfect and absolute estate of Inheritance in fee simple and have in myself good right free from and lawful authority to grant, bargain, sell, convey and ___? the said bargained premises in manner as aforesaid and that the said Jonathan SPIVEY his heirs and assigns of all and may from time to time or at all times forever hereafter by forece of these present lawfull peaceably and quiety have lived, use, occupy, possess and enjoy the said demised and bargained premise with the appurtenances free and clear and freely and cleary acquitted, exonerated and discharged of form all and all manner of the former gifts, grants, bargains, sails, leases, mortgages, wills, entails, joynters, doweries, judgments, executions, encumbrances and extents f___?. I the said Caleb SPIVEY for myself my heirs, Exes and Adms do covnant and engage the above demised premises to him the said Jonanthan SPIVEY his heirs and assings against the lawful claims or demand of any person or persons whatsoever forever hereafter to warrant, secure and defend and Mary the wife of me Caleb SPIVEY doth by these present give willing and yield up and surrender all her rights of dowry and ___? of thirds of in and im___? above ___? premise with him the said Jonathan SPIVEY his heirs and assigns.
