Transcribed by LisaGraham32@aol.com BOOK B PG.84 John Tiney & Wife to John Drake North Carolina , Ye to all People to Whom, these presents shall come, I, John Tiney and Mary, wife of Bertie send greeting. Know Ye that I, the said John Tiney for and in consideration of the sum of twenty Pounds to me in hand paid and secured to be paid at and before the ensealing and delivery of these presents by John Drake of the precinct aforesaid the receipt whereof I doe hereby acknowledge have and by these presents do freely, fully clearly and absolutely give grant, bargain, sell, alien ,Enfeoff , release , convey & confirm unto the said John Drake his heirs assigns forever a certain Tract or Dividend of Land situated and lying in the Precinct aforesaid containing by estimation three hundred and Forty Acres be the same more or less. Beginning at a popular in the Hunting Quarter Swamp, Richard Washington's Corner tree then turning along his line and the corner SO.WT. 320 pole to a white oak in a needy slabb then So. No. Wt. 140 pole to a live oak standing on the north side of the Potticassie Creek, thence the winding of the Creek and of Hunting Quarter Swamp to the first station together with all houses, outhouses, Orchards, Garden woods, underwoods and all other the premises with the appurtenances to the said tract of land belonging in or any wise appertaining To have & to hold the said Tract of land with the appurtenances thereof, containing three hundred forty acres more or less and I the said John Tiney do promise and Warrant that at the time of the Ensealing and delivery hereof am fully possessed of the said tract of land with its appurtenances in fee simple and have in myself good right and full power and lawful authority to sell and dispose there of in manner as aforesaid the same being freely and clearly acquitted, exonerated and discharged of and from all and all manner of former and other gifts grants bargains sells leases releases quick claim and all other incumbrances whatsoever Further I the said John Tiney do for myself my heirs, Executors, Administrators covenant, grant and agree to warrant and forever defend the said tract of land with all singular the appurtenances unto him the said John Drake his heirs and assigns forever against the lawful claims, claims and demands of all and every other person or persons whatsoever, In witness whereof I have here unto set my hand and seal this 8th Day of October 1725 - John Tiney (Seal) Signed Sealed & Delivered in presence of us- John Sutton, Mary Sutton X Bertie County February 6th 1725 The Above Deed of Sale was in Open Court Acknowledged by John Tiney in due form of law who on motion is ordered to be registered -, Teste- Notes: Definitions Alien- To Transfer (Lands, Title) to another.
