JOHNSTON, WILLIAM H. SCOVILLE, and JOHN T. JOHNSTON, and THOMAS W THOMPSON, merchants under the firm of Johnston and Thompson of the third part. Witnesseth that whereas the said WHITMELL RUFFIN is justly indebted to the said William Pugh, John T. Johnston, Wm H. Scoville and Johnston and Thompson in the sum of TEN HUNDRED and SEVEN DOLLARS and eighty eight cents (viz). William Pugh in note and account one hundred ninety four dollars and sixty three cents. John T. Johnston in a note of Five hundred sixty six dollars and eighty eight cents; Wm H. Scoville by note and account sixty four dollars and eighty six cents Johnston and Thompson one hundred eighty one dollars and fifty one cents all including interest up to this day. And the said Whitmell Ruffin being willing to secure the payment of the same; now this indenture witnesseth that the said Whitmell Ruffin for and in consideration of the purposes aforesaid and the further sum of one dollar to him in hand paid by JESSE AVERITT, the receipt whereof is hereby acknowledged have granted, bargained and sold unto the said Jesse AVERITT, his heirs and assigns the following property: One Negro Man named Dace A Negro woman Pherebe Three children Mary, Peter and Lucida Sixty acres of land in the county of Bertie adjoining the lands of Richard Vale, Silks Smith and others. Another tract of land adjoining the lands of Wm Hinton and Marmaduke R. Ackee and others containing thirty seven and a fourth acres more or less in said county. Two head of horses, ninety head of hogs, consisting of some Shoats and pigs and one half of an undivided stock of cattle owned jointly with John G. Johnston, one yoke of oxen (cart and ?. Three bedsteads and bed clothes, four B___ brandy, present cossin? fitting chairs, household and kitchen furniture, six ploughs and frames, two ploughs, one and saw, three chisels and three augurs. The present crop of corn, fodder ____. __two hundred barrels, 30 empty barrels, two pots one oven, 1 tea kettle, 1 saddle and bridle, three tabbs, 1 still cap and worm 2 iron wedges and 4 weeding hoes, To have and to hold the said Negroes and other property until the said Jesse AVERITT, his heirs and assigns forever, upon this aforesaid trust and confidence (viz). That if the said Whitmell Ruffin, his heirs or assigns doth fail to pay unto the said William Pugh, John T. Johnston, William H. Scoville and Johnston and Thompson their heirs or assigns the aforesaid sun of Ten hundred seven dollars and eighty eight cents each to be paid as aforenamed together with he interest and all costs attending this deed in trust on or before the first day of January 1825, Then in that case the said Jesse Averred is authorized and empowered at the request of either of the parties after giving ten days notice in three public places to sell the said Negroes and property beforenamed at public sale at Scoville's Store for cash to the highest bidder, and after paying the said debts to William Pugh, John T. Johnston, William H. Scoville and Johnston and Thompson and the cost attending this instrument; the balance if any pay unto the said Whitmell Ruffin his heirs and assigns. But in case the said Whitmell Ruffin shall pay or cause to be paid unto the said William Pugh, John T. Johnston, William H. Scoville, and Johnston and Thompson the aforesaid sum of Ten Hundred Seven dollars and eighty eight cents to be paid to each as aforenamed inst and cost, at any time before a sale has been made then and in that case the said Negroes and property before named shall be vested inthe said Whitmell Ruffin again as though this deed had never been made and lastly the said Jesse AVERITT does bind himself his executors and administrators well and truly to do and perform all and everything required of him by this deed according to the true intent and meaning. In witness of all which we the parties have hereunto set our hands and seals at Woodville, Bertie County and state of North Carolina, the fourteenth day of August A.A. one thousand eight hundred and twenty four.
