All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Harmon trekkergen@gmail.com July 27, 2015, 1:17 pm Source: Raleigh State Archives, North Carolina Written: April 19, 1819 Recorded: August 1821 BENJAMIN HARDY WILL In the name of God Amen: I Benjamin Hardy of the County of Bertie in the State of North Carolina being of sound and disposing mind and memory do this nineteenth day of April in the year of our Lord one thousand eight hundred and nineteenth make and ordain this my last Will and Testament as follows: First, I lend unto my beloved wife Eleanor Hardy all my estate real and personal (except such as is hereafter mentioned to be sold for the payment of my debts and the necessary costs and charges for the settlement of my estate, to her my said wife during her natural life, or widowhood, to enable her to raise and educate my children at her own and my executor’s discretion, and provided my wife should marry then her proportion must be laid off to her agreeably to law and the balance to be kept together by my executors for the purpose of raising and schooling my children until the youngest child arrives of age then to be divided among my children as herein after directed and if my wife should die before my youngest child comes of lawful age I wish my estate to be kept together as above mentioned. Secondly, I hereby authorize and empower my executors to sell on such terms as they may deem advisable for the benefit of my estate the following parcels of land (to wit) one tract bought of Thomas Holley and Sarah Freeman containing two hundred twenty one acres joining the lands of Wm. Smith, Jon. Smith and others, one other tract of one hundred acres bought of Henry Ray joining the land of David Bryan and others, and one undivided half of a tract of three hundred and fifty six acres purchased by Thomas Holley and myself from Charles Sowell. I also empower my executors to sell such part of my personal property as my wife can best spare to enable them to pay all my just debts. Thirdly, I give and bequeath all the balance of my estate real and personal after my wife’s death or widowhood, or the coming of age of my youngest child, to be equally divided between all my children that may be then living share and share alike to them, their heirs and assigns forever. Lastly, I hereby nominate and appoint my loving wife, Eleanor Hardy Executrix and my friend Josiah Holley and my son Humphrey Hardy Executors to this my last Will and Testament, hereby disannulling and revoking all former wills by me made ratifying and confirming this and none other to be my last Will and Testament.
