Harrell of the County and State offoresaid being of sound mind and memory, but considering the uncertainty of my earthly existence, do male and declare this my last will and testament, in manner and form following that is to say. First that my executor herin after naned shall give my body a decent burial, and pay my funeral expences. I will and bequeath to my sons William E. Harrell, Juo? T Harrell and Wood Harrell, the Whitaker tract of land on which W.E. Harrell now lives, containing 400 acers, each to have 133 ½ acres wach. 2 the bond tract containing 20 acers to be sold private or public, and the money wqually divided between my three daughters Bessie, Burnie, and Kate and three sons, Joe, Scott and Benjamin. 3 a tract of land known as Jarrot Cooper tract of land I give and bequeath to Joe Harrell, Scott Harrell and Benjamin Harrell and Bessie Hoggard, Burnie Morris and Kate Womble, each to hold and equal right. And all my personal property, consisting of horse,hogs farming untensils?Co. to be sold and the proceeds equally divided between Joe, Scott, Benjamin, Bessie, Burnie, and Kate, or any other disposition that they all agree upon. I herby appoint my son Joe J. Harrell executor of this my last will to all intents and purposes. I hereby appoint my son Joe J. Harrell executor of this my last will to all intents and purposes. Ioe J Holiday North Carolina, Bertie County The aforesaid paper writing purporting to be the last will and testament of D, C. Harrell, deceased, is this day exhibited in open court for probate, and the due execution thereof, by the said D. C. Harrell, is proved by the oath and examination of J. R. Cherry and W. I Holiday, the subscribing witnesses thereto; and it is further shown to the satisfaction of the court by the oath and examination of said witnesses, that the said D. C. Harrell was, at the time of making said will ond sound mind and memory, of full age to make a will and under no restraint to their knowledge, information or belief. It is therefore, considered, adjudged and decreed that such proof is sufficient and according to law, and that said paper writing is and contains the last will and testament of D. C. Harrell, deceased, and it is ordered that said will be admitted to probate and recorded in the Book of Wills of Bertie County, and as such filed as provided by law, in the office of the Clerk of the Superior Court for said County. Harrell, Deceased Clerk Superior Court Joe J. Harrell be duley sworn, doth say: That D. C. Harrell, late of said County is dead, having first made and published his last Will and Testament, which had been admitted to probate, and that affiant is the Executor named therein. Further the property of the said D. C. Harrell consisting of Horse, buggy, corn. Fodder, crop, Kitchen furniture, hogs and about 20 acres of land is worth about $200.00 for as can be ascertained at the date of this application; and that Bessie HoggardBurnice Morris and Kate Womble, Joe Harrell, Scott Harrell Benj. Lyon Clerk Superior Court Upon considering the applicatrion of Joe J. Harrell for Letters Testamentory upon the estate of D.C. Harrell deceased, and it appearing therefrom that said Joe J. Harrell the executor mentioned and appointed in the Last Will and Testament has een admitted to probate, it is Ordered and adjusged that the said Joe J. Harrell be allowed to qualify as executor upon the estate of D. C. Harrell deceased as orivuded by law, and enter upon the discharge if the duties imposed by said trust; and said Jeo J. Harrell this day comes into open Court and Qualifies as such executor buy taking the oath prescribed by law, and thereupon Letters Testamentory issue. This 29 day of October 1898. w.l.Lyon Clerk of Superior Court Notes: I am hoping this will give ties to other family and the parentage of D.C. Harrell. He is Don or Donald Callus Harrell. I think his mother was Elizabeth because I find him several times with an Elizabeth when he was a young boy and later in life. Never saw an older man that could have been a father figure.
