Hoggard Will - 1884 State of North Carolina Bertie County I Thomas W. Hoggard of Bertie County and State aforesaid being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and Testament in manner and form following that is to say: First, That my executors hereinafter named shall provide for my body a decent burial suitable to the wishes of my relative and friends and pay all funeral expense together with my just debts howsoever and wheresoever owing out of the moneys that may first come into their hands as a part and parcel of my estate. Item 1st I lend to my beloved wife Jenatt E. Hoggard during her life all my property, real personal and mixed of what nature or kind soever and wheresoever the same shall be at the dime of my death. Item 2nd I give and devise to my son Jesse Hoggard after the death of my beloved wife the tract of land where on he now lives, Known as the Woods tract containing ninety acres more or less said land begins on the Road at a cross fence thence north course to Rufus Mitchell's line, to have and to hole to him and his heirs in fee simple forever. Item 3rd After the death of my beloved wife I lend to my eldest daughter Nancy E. Morris, wife of John P. Morris, two hundred acres of land during her life, after her death I give said land to her children, provided however that if the said Nancy E. Morris should die leaving no children, then and in that case, I give said land to my son Jesse Hoggard and Jennett C. Morris wife of William J. Morris to be equally divided between them, said land begins at a fence in William Pritchard line, thence __________line of marked trees to the ________, said land being that tract of land whereon Jennett E. Morris and John P. Morris now live, to have and to hold to her and her heirs if fee simple forever. Item 4th I give and devise to my daughter Jennett C. Morris wife of W. J. Morris all the land that I may own at the time of my death that had not __________________ items of this my will to have and to hold to her and her heirs forever. Item 5th I give and bequeath to George Mitchell one bed and furniture to him and his heirs forever. Item 6th I give and bequeath to Penelope E. Mitchell wife of Rufus Mitchell the sum of twenty dollars to be paid by my executors within one year of the time of my death out of any money belonging to my estate not otherwise disposed of in my will. Item 7th I give and bequeath to my daughter Jennett C. Morris wife of W. J. Morris after the death of my beloved wife, all the residual of my estate not otherwise given away in a former item of this my will, of which nature or kind soever and wheresoever the same shall be at the time of my death, to her and her heirs absolutely forever. And lastly I do hereby constitute and appoint my trusty friends Jesse Hoggard and William J. Morris my lawful executors to all intents and purposes to execute this my last will and testament according to the intent and meaning of the same, and every part and claim -------- and declare utterly void all other wills and testaments to by me heretofore made. In witness whereof I the said Thomas W. Hoggard do herein set my hand and seal this the 30th day of January 1884 Signed sealed and declared by the his said Thomas W. Jenkins North Carolina Superior court Bertie County Before the Clerk The executors of the foregoing paper writing purporting to be the last will and testament of Thomas W. Hoggard deceased I this day proved before the undersigned clerk of the Superior Court of said County by the oath and examination of A. Jenkins and C. C. Jenkins the subscribing witnesses thereto each of whom for himself says: that he is a subscribing witness to said paper writing that the said Thomas W. Hoggard in his presence subscribed his name at then of said paper writing declaring the same to be his last will and testament and that at his request in his presence, he subscribed his name as an attending witness's thereto; that at the time said paper writing was so executed the said Thomas W. Hoggard was of sound mind, of lawful age to execute a will and was not under any restraint to the best of his knowledge, information or belief. The said paper writing and every part thereof is adjudged to be the last will and testament of Thomas W. Hoggard deceased and the same is ordered to be recorded and filed. At the same time Jesse Hoggard and W. J. Morris the executors therein named are duly qualified and --------- testament by issue. Witness my hand this 22nd day of June 1893. W. L. Lyons Clerk Superior Court Bertie County-In the Superior court In the matter of the will of Thomas W. Hoggard Before W. L. Lyon Clerk Jesse Hoggard and W.. J. Morris being duly sworn____ say: That Thomas W. Hoggard, late of said County is dead having first made and published his last will and Testament, and that they are the executors named therein. Further that the property of the said Thomas W. Hoggard consisting of land and personality is worth about $750 so far as can be ascertained at the date of this application; and that Jennett E. Hoggard, Jesse Hoggard, Nancy E. Morris, Jennett C. Morris, George A. Mitchell, Penelope E. Mitchell are the parties entitled under said will to the said property.
