Bertie County North Carolina Will Hoggard, William-1822 File contributed for use in USGenWeb Archives by Robbie Burnett rburnett@hughes.net ========================= William Hoggard Will - 1822 State of North Carolina Bertie County In the name of God Amen I William Hoggard of the county and State aforesaid being in my perfect mind and memory do this day make my last will and testament and as touching such property wherewith it has pleased God to Bless me, I give and dispose of in the following manner & form, viz; First- I give and bequeath unto my son Elisha Hoggard four hundred acres of land (more or less) being the same whereon he now lives, also the following Negroes, Philius, Calin, Maley, Ether, & Margaret to him & his heirs forever- Secondly-I give and bequeath to my son James Hoggard two hundred acres of land (more or less) being the same where on he now lives, also the following Negroes, (vis) Peter, Harty & Jack and all my accounts, I have against him to him and his heirs forever- Thirdly-I give and bequeath unto my daughter Tempy Bunch the following Negroes, Vines & her children Daniel, Solomon, Mary, Silvey, & Long & Betty to her & her heirs forever- Fourthly-I give and bequeath to my two grand children Harriet M_____ and Betty Penny Hoggard the Children of my daughter P_______ the following Negroes (vis) Joe & Hannah & her four children & if either of my above named children ______ before they arrive to the age of twenty one years or are married I wish the survivor to have the whole of said Negroes, but in case both should die under the age of twenty one or before marrying, then and in that case, I wish the aforesaid Negroes to return to my Estate- Fifthly I give and bequeath unto my son John Hoggard two hundred acres of land (more or less) being the same where he now lives and one tract on Quinn? Hale? Swamp, bounded by Davis Waterford & David Rice's lines containing two hundred acres (more or less), also the following Negroes, Abel, Rachel, Dennis, Gennet, Ride, Nancy, Hester, Bridget & David & Georgia & his heirs and assigns forever Sixthly I give and bequeath unto my daughter Susannah Hoggard two hundred acres of land (more or less) being the same whereon I now live, also the following Negroes Dampe, Iona, Harriss, Violet, Louiza & Moses to her & her heirs forever and if my daughter Susannah should die without a lawful heir it is my will that her land and Negroes shall be divided between my children that are living. Lastly-I nominate constitute and appoint my sons Elisha Hoggard and John Hoggard Executors to this my last will & testament ratifying & confirming this & no other to be my last will and Testament. In witness whereof I have hereunto set my hand & seal this 30 day of October 1822 Signed, Sealed published & William Hoggard Seal declared in presence of Zachieus Champion David Rice Solomon Rice State of North Carolina May Term 1823 Bertie County Court This paper writing was exhibited in open court for probate as the last will and testament of Wm Hoggard, dec'd when the probate thereof was contested whereupon a lawful jury being impaneled & sworn say that the said paper writing purporting to the last will & testament of Wm. Hoggard dec'd is his last will & testament & therefor it was ordered by the Court that the same be recorded at the same time Elisha Hoggard on of the executors therein named qualified as such. E. A.
