Hoggard Will State of N. Carolina Bertie County I Worley T. Hoggard of the county and state aforesaid being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say, First, That my executors shall provide for my boddy a decent burial suitable to the wishes of my friends and relatives; and pay all burial expenses together with my just debts to whomsoever owing; out of the moneys that first comes into his hands as a part of the proceeds of my estate, 1. I leave to my wife Catherine Hoggard all my land during widowhood. 2. It is my will that my executors sell enough of my personal estate to pay my just debts. 3. I leave to my wife all the remainder of my personal estate during her widowhood. 4. At the death or marriage of my widow I give and bequeath to my two sons Wm. T. Hoggard and Charlton L. Hoggard, all of my lands upon the following conditions; that is to say, that my son Wm T. Hoggard pay over in money to my daughter Claudia Hoggard fifty dollars, and that Charlton L. Hoggard pay over to my daughters Marthy J. Hoggard, Allie Luada, and Cornelia O. Hoggard each fifty dollars apiece. 5. At the death or marriage of my widow I give to my daughter Bettie C. Hoggard fifty dollars. 6. It is my will, and it is so order, that at the death or marriage of my widow all my property not before disposed of be equally divided between my daughters, Claudia Hoggard, Marthy J. Hoggard, Allie Luada Hoggard, Bettie C. Hoggard and Cornelia C. Hoggard. Last I do hereby appoint and constitute my friend Wm H. Brown my lawful executor to this my last will and testament according to the intent and meaning thereof in witness where of I the said Worley T. Hoggard do here unto set my hand and seal this the 4th day of June A.D. 1888. his W. T. x Hoggard mark Signed sealed published and declared by the said Worley T. Hoggard to be his last will and testament in the presence of us who at his request and in his presence do subscribe our names witness thereto. B. B. Williams ______ Lee North Carolina Bertie County In the Superior Court The execution of the foregoing last will and testament of W. T. Hoggard was this day proven before me by the oaths and examination of B. B. Williams and ____ Lee the subscribing witnesses thereto each of them after being duly sworn says that W. T. Hoggard the testator in their presence subscribed his name at the end of said will and that they at his request, in his presence and in the presence of each other witnessed the same, that the said testator at the time of the signing said will declared the same to be his last will and testament , That at the time of the signing of said will by said testator he was of sound mind, of lawful age to make a will and was under not restraints to their knowledge or belief. The said will admitted to probate and hereby ordered to be recorded. At the same time Wm. H Brown the executor named in said will was duly qualified as required by law.
