And whereupon the same James Exor. aforesaid by Blake BAKER his attorney complains that whereas the aforesaid Barneby on the 25th day of August in the year of our Lord 1747 at Bertie County in the province afsd., made his a certain note in writing called a promisary note with his proper hand and mark thereto subscribed bearing date the day and year afsd., and then to these delivered the same note the afsd., James MANEY the testator in his life time by which sd. note the afsd. Barnaby promised to pay to the afsd. James MANEY in his lifetime in his order the just sum of four pounds current money of the Colony of Virginia to wit of the value of three pounds four Shillings Lawfull money of ___?____? demand for value in the sd. note mentioned to be received and the afsd James MANEY E__? afsd. in fact says that neither the Testator in his lifetime nor the afsd. James Exor. afsd. after the death of him the sd. James MANEY hath not ordered or appointed the said sum of money for any part thereof to be paid to any person whatsoever by reason of which said promises and also by force of the of the statute in such cases made be provided the sd. Barneby became lyable to pay to the afsd. James MANEY in his lifetime _? yet is Lyable to pay to the afsd. James Exor. afsd. the sd. sum of four pounds contained in this note afsd. then he should be thereto required and the and the same Barneby being so Lyable in consideration there of afterwards to wit the same day and year above sd. at Bertie afsd. confirmed? upon himself to the same James the Testator in his lifetime then and there faithfully promised that he the afsd. Barneby the same four pounds in the note afsd. according to the tenor? and effect of the same note to the same James MANEY in his lifetime when afterwards he should be thereto required would well and faithfully pay to content- Nevertheless the afsd. Barneby not alt all regarding his promise and asumptions afsd. made but contriving to fraudalion by intending the same James MANEY the Testator in his lifetime in his particular conflict and sublilly to decease and fraud hath not paid the afsd.
