WERSINGER In the name of God Amen I Zadock Mitchell of Bertie County and the State of N Carolina being weak in body but sound in memmory do make and ordain this to be my last will and testiment knowing the uncertainty of life and the certainly of death after recommending my spirit under God who gave it me and have blessed me with worldly property thanks be to him for the same my will is to dispose of the same in the following manner viz after my funeral expences and my just debts are paid I divise my remaining property in the following manner-- Item 1st I give unto my daughter Mary Burdin the wife of Abram Burdin the land which I bought of Cader Mitchell supposing to contain four hundred acres be it more or less to her and her lawful heirs and assigns forever-- Item 2nd I give unto my daughter Mary Burdin the wife Abram Burdin the within named negroes viz Lewis Peter Grace Sarah Betty Wright Emma and Delia their increase unto my daughter Mary Burdin her and her lawful heirs and assigns forever-- Item 3rd I give unto my son James L. Mitchell one tract of land which I bought of Josiah Jenkins containing by estimation four hundred acres be the same more or less to him and his heirs or assigns forever-- Item 4th I give unto my son James L. Mitchell the following negroes viz Ben Bryant Leah Silvy Ned Delilah Daniel Dennis Esther Nancy and their increase to him and his lawful heirs forever-- Item 5th I leave unto my son James L. Mitchell the sum of five hundred dollars in cash or good notes to be paid unto my son James L. Mitchell by my executors hereafter mentioned if any money or notes should be remaining to be equally divided between my executors-- Item 6th I leave Jenny and her four children viz Rosette Venus Lucy and Randolf and their increase if there should be any to be sold by my executors and the money arising from them to be equally divided among my grandchildren to them and their lawful heirs forever-- Item 7th I lend unto my wife Polly Mitchell all the ballance of the land which I have not given away which contains about eight hundred and thirty acres which she is to occupy her natural life then to belong unto my son William D. Mitchell to him and his lawful heirs forever-- 8th It is my will and desire that my wife Polly Mitchell to pay all my just debts out of the property which I lend her or the interest arising there from-- 9th I lend unto my wife Polly Mitchell all the household and kitchen furniture likewise the following negroes viz Charles Dennis Bob Sally ?Teresa Pen Annis Blount Cherry Joe Harriett unto my wife Polly her natural life then to belong unto my son William D Mitchell to him and his lawful heirs and assigns forever-- 10th The stock of every kind which I leave is for the support of my wife Polly Mitchell and the negroes which I lent her during her natural life-- 11th item I also lend unto my wife Polly Mitchell one still also the tools belonging to my blacksmith shop likewise the liberty of having work done in the same then after her natural life to belong unto my son William D Mitchell to him his lawful heirs and assigns forever-- 12th item I also lend unto my wife Polly Mitchell one ?ridding chair durring her natural life, then to belong unto my son William D Mitchell him and his heirs and assigns forever-- 13th If there should be any thing that is at this time not recollected by me at this date the said things to belong unto my son William D Mitchell to him and his heirs and assigns forever-- 14 Item I do also appoint my wife Polly Mitchell and my son William D Mitchell executors of this my last will and Testament revoking all others heretofore made this the 26th of February in the year of our Lord 1831 as witness my hand and seal Signed sealed and acknoledged Zadock Mitchell presence of Jno J Hoggard Wright Mitchell State of North Carolina Bertie County Court Febry Term 1834 This will and testament of Zadock Mitchell was proved in open court by the oath of Wright Mitchell one of the subscribing witnesses & at the same time William D Mitchell and Polly Mitchell the executor and executress therein named qualified as such & ordered to be recorded ?Jos.
