Murray" ================================================= WILL Epaphroditus MOORE d.1757 In the Name of God Amen. The 11th Day of June in the year of our Lord Christ 1757. I Epaphroditus Moore of bertie County in the Province of North Carolina being of perfect mind and memory thanks be given unto God Therefore Calling unto mind the mor- tality of my Body and knowing that is appointed for all men once to die do make & Ordain this my last Will & Testament that is to Say principally & first of all I give & recommend my Soul into the hands of God that gave it, and for my body I Recommend it to the Earth to be buried in a Christian like & decent manner at the discreation of my Executors nothing doubting but at the generall Resurrection I Shall Receive the Same again by the mighty power of God, and as touch- ing Such Worldy Estates wherewith it hath pleased God to bless me in this life, I give devise and dispose of the Same in the following manner & forme primis I give to Elizabeth my dearly beloved Wife the free use & liberty of all my Negores Houses Land & Plantation where on I now live during the time of her Naturall life, or time of her Widowhood___________ Item I likewise give to my Three daughters Mary, Ann and Grace free liberty to stay on the Plantation whereon I now live after my and my wifes decease and to have the use of all my houses Platation & land untill they marry or the Cause to leave it themselves Excepting the use & benefit of my young Crabtree Orchard and my Son John Moore's Orchard, the benefit of which I give to my Said Son John More after my decease but the use & benefit of the Old Orchard I give to my Three Daughters before named with the liberties aforesaid Item I give unto my grandSon Elisha Wilson two hundred Acres of Land, more or less, lying on the Southwest Side of the Fort branch begining at Samuel Dun ings (New Page) ings Corner tree Standing in the mouth of the Cow branch, on the side of the Fort branch Runing thence down the Fort branch to the mouth of a Small branch that runs up by the Stony Woolf-Pit and from thence a Strait Course to another Corner tree of Samuell Dunings Standing in the Dogwood marsh, & from thence to the first Station, and also one negroe girle named Venus She & her Increase, and likewise four Cows & Calves they & their Increase, also my own feather bed & furniture, whereon I now lie, to him & his heirs for Ever. But if the Said Elisha Wilson Should die without heir, then his Said part to fall to his mothers Children that She hath be her husband John Hurst to be Equally divided among them_____ Item. I give unto Thomas Moore Son of my daughers Ann More, Two hundred Acres of land more or less, ly ing on the afor, Fort branch Joining to the Said E- lisha Wilsons, begining at the mouth of a Small branch Elisha Wilsons Corner on the Fort branch then Runing down the fort branch to the mouth of Graces branch, then up the Said branch to the fork, then up the Northwest Psong to the pa- tent line then a long the Said line to a Corner tree and from thence to Samuell Dunings Cor ner tree Standing in the Dogwood marsh and from thence to the first Station and also one negro fellow named Peter, his mother Ann Moore having the use of him During his life and likewise one feather bed & furniture, also three Cows & Cavles they & their Increase and one young Horse, and also one of my hunting guns to him and his heirs for Ever_____________ Item I give unto my daughter Judath Hurst one Cow & Calf she & her Increase Item. I likewise Constitute make & Ordain my two daughters, Mary and Ann Sole Executixes of this my last will & testament, and I do hereby Utter- ly disallow, revoke & disanull all & Every other former Wills Testaments & legacies by me in any wise before made Ratifying & Confirming this & no other to be my last will & Testament In Witness there of I have hereunto Set my hand & Seall. the day & year before written Signed Sealled & declared by the Said Epaphroditus Moore as his last will & Testament in the Presents of us his Subscribers Charles Horne Demcy Holland Lewis Perry Epaphroditus Moore(SEAL) Bertie County of October Court 1757 The before Will was Exhibited into Court by Mary Moore and Ann Moore Executixes there of and Produced by the Oath of Charles Horne one of the Subscribing Witnesses Thereto and Whereas some disputes have arisen concerning the said Will It was ordered that Letters should not Issue on the same Untill after next Court. And also that all the Subscribing Witnesses thereto Should be Summoned to appear at the next Court to be Interrogated on & about Relating Here to. Test: Benj.
