I Humphrey Nicholls of Bertie County & State of North Carolina being infirm in Body but in perfect health do make and ordaining this my last will & Testament in order following that is to say, I give and recommend my soul into the hand of Almighty God that gave it and my body recommend to the earth to be decently interred at the discretion of my Executors and touching such worldly estate with which is has been pleased God go bless me with. I will and bequeath in the following form -- and fist I send unto my beloved wife, Sarah Nicholls during her natural life or widowhood, all my land and plantation, on the west side of the branch called Stoney Run with all the houses, orchards & timber therefore unto my s (?) during s(?) term all my Negroes, Horses, Cattle, sheep & hogs & all other my moveable Estate [except what must be sold to pay my just debts] & such as I shall give to my hereafter and after her s(?) wifes Death or marriage to be divided amongst my children as follows (that is to say I give unto my son John Nicholls one Large Bible and one Negro boy called Allen and a fourth part of my household goods after my wifes death or marriage. I give unto my son Henry Nicholls all that part of my land & plantation on the East side of Stoney Run and one Negro man called Caesor (& one Negro boy called (this has been scratched out) & a fourth part of my household goods and one set of blacksmith tools & one Silver Bowl. I give unto my son George Nicholls one Large Book called Burkhill on the New Testament and a Negro boy called Robbin (or Bobbin) (the following scratched out: I give unto my (can't read) son Osborn Nicholls ten pound good (can't read) to be raised out of my Estate after my wifes death in full for his part of my Estate) I give unto my son Osborn Nicholls one Negro boy named (can't read) I give unto my son Benajah Nicholls all my land & plantation on the West side of the Branch Stoney run and one Negro boy called Charles and a fourth part of all of my household goods & one half of all my stock of Horses, Cattle, Sheep & hogs that shall be after my wifes death. And it is my will and desire that all the rest of my Estate that is not given away after my wifes death be equally divided between my Beneajah & my Daughter Fanny, and that my executor sell so much of my household good & stock as will pay my just Debts as soon after my Death they can & give six tenth criditt (?) & it is my will and Desire that if my son Henry or my son Benajah should die without lawful issue & have not sold their land in their lifetimes, that then i that case the survivor will have Land & the rest of his Estate shall be divided amongst John, George & Fanny, it is likewise my desire that my wife kill as many of my cattle, hogs & sheep as will serve her & family in meat. And I do hereby appoint my well beloved wife Sarah Nicholls my Executrix, and my son John Nicholls & my son Henry Nicholls my Executors of this my Last Will, Revoking and disannulling all other wills before me made ratifying & Confirming this and none other to be my Last Will & Testament, signed, sealed, published, pronounced and Delivered to be my Last Will & Testament H. Nicholls (seal) in presence of Jn P Nicholls William F. Ceetwood Elizabeth Williams This November 27, 1790 A Codicil to the within will: Be it known to all men by these present that J.H. Nicholls of the County of Bertie, farmer have made and declared my Last will and Testaments i writing bearing Date of November 27th, one thousand seven hundred & ninety I then (?) H. Nicholls this present Codicil do ratify and confirm my (?) Last Will and Testament, and to farther give and bequeath unto my son John Nicholls a part or parcel of my lands, the line beginning at the Corner Tree in the perosan (?) and running a Southe (?) Easterly course long a line of marked trees to a oake tree in Thsp (?) Thepans Line all that part of parcel of land between the (?) line and the Land I sold to George Lockhart, Esq and my will and meaning is that this Codicil be adjudged to be a part and parcel of my last will and Testament and that all things (?) mentioned and contained be faithfully and performed, and as fully and amply in Every respect as if the same were so Declared and set down in my said last will and Testament.
