BERTIE COUNTY WILL - OLIVER, John -1772 File contributed for use in USGenWeb Archives by goroke@cyberspace.org Charles Oliver      [WILL OF JOHN OLIVER] In the Name of God Amen  I John Oliver of Bertie County in the province of North Carolina Being Sick and weak in Body But of perfect Mind and Memmory And Calling to Mind the Mortallity of My Body and knowing that it is appointed for all Men once to Die Do Make Ordain Constitute and appoint this My Last will and Testament in Maner and form following that is to Say first and principally I Recommend My Soul to God that Gave it and My Body to the Earth to Be Buried in a Christian like Maner at the Discretion of my Executors hearafter Named  And as touching My Worldly Goods I Give and Dispose In Maner following ------------ Imprimus  I Give and Bequeath to My Daughter Elisabeth Stand Back Dureing her Natural Life the plantation or piece of land She My Sd Daughter and her husband Thos. Standback Now liveth on it being the upper part of the TractI My Self Live on Viz  Beginning on Roanoak River on the upper side of My plantation or Clear'd ground and Running of from the River a long a line of Marked trees till it Come to Rhode's Mill Branch then along the Mill Branch to the divition line that is Between Me and then to Rhodes then along the Divition line till it Come to the aforesd River then Down the River to the first Station Containing by Estimation     Acres Be the Same More or Less: I Say to her My Sd Daughter Elisabeth Standback Dureing Natural Life  As also I Give and Bequeath to My aforesd Daughter Elisabeth Standback Dureing her Natural Life as aforesd three Negroes to witone Negro wench Called philly one Do. Called Dorcas and one Negro boy Called Sam and also a bed and furniture Called My Bed -- And further My Will and pleasure is that in Case My Sd Daughter Elisabeth Standback Die or Depart this Life Leaveing Issue Child or Children begotten of her Body Which Shall or May Survive her Then I Say the Land and Negroes above Mentioned I Give and Bequeath to her My Sd Daughter Elisabeth Standback and her heirs for Ever But if it may please almighty God that She My Sd Daughter Elisabeth Standback Depart this Life Leaving No heir Child or Children Begotten of her Body as above Sd My Will and pleasure is that then the above Sd Land and Negroes Decend and be to My Son Andrew oliver and his heirs ------- Item  I Give and Bequeath to My Daughter Sarah Hurst the use and Labour of My Negro Man Called Sesor Dureing her Natural Life and if My Sd Daughter Sarah Die or Depart this life Leaving Issue Child or Children Begotten of her Body then I Say the above Sd Negro Man at the Deceace of My Sd Daughter Sarah to Desend and be to the Issue Child or Children of my Said Daughter Sarah: also My Will and pleasure is that My Executor Rais the Sum of two hundred pounds out of My Estate and that he put the Same out on Intrest until John Hurst Son of My Daughter Sarah Hurst Come to Be of Lawful Age and then the Sd two hundred pounds and the intrest to be paid by My Executor to him the above Sd John Hurst and to Such other Child or Children as She My Sd Daughter Sarah May have to be Divided to and among them the Children of My Sd Daughter Sarah in Such Sort and Maner as he My Executor Shall or May Se Cause --------- Item  I Give Devise and Bequeath to My Son Andrew Oliver all and Singular the Rest of My Estate ["My Estate" is repeated at the top of the second page] My Estate Both Royal [!] and personal I Say to him My Son Andrew Oliver and his heirs for Ever Lastly I ordain Constitute and appoint him My above Sd Son Andrew Oliver My Executor to this My Last Will and Testament to Se the Same Executed and performed According to Law In Witnes Whareof I the Sd John Oliver Do hear unto Sett My hand and Seal this twentieth Day of December In the year of our Lord Christ one thousand Seven hundred and Seventy two Sign'd Seal'd pronounced and declared  }      In the presents of us -----       }          John Oliver Jos.
