I John Anthony Phelps, of the county of Bertie, in the state of North Carolina do make, publish and declare this to be my last will and testament. First, I desire and direct my executor to pay all my just debt and burial expenses. Secondly, I leave to my wife Ann Maritta, during her life or widowhood, any horse and buggy, as much of the household and kitchen furniture, farming utensils and stock of cattle and hogs as she may need for her own use -also, the tract of land on which I now reside. The remainder of the furniture, farming utensils and stock to be sold by my executor. Thirdly, after the death or marriage of my wife Ann Maritta I wish my son, William Anthony to have his choice of the lands - My son Joseph Cooper and daughter Mary having already received and in possession their lands, the **** clothing to be equally divided between my son William Anthony and Joseph Cooper. The remainder of the household and kitchen furniture to be sold. Fourthly, I give to my daughters Mary and Elizabeth fifty dollars each and the remainder of the money to be equally divided between all my children. Fifthly, I give to my wife, Ann Maritta, during her life or widowhood thirty dollars per year and if she should need more, I want my executor to give it to her out of the interest on my notes. Sixthly, I give a bequeath to my son Joseph Cooper the tract of land on which he now lives. Beginning at a **** (?) ****(?) , *****(?) corner and running south to ***** (?) rail road ****(?) down the rail road to the Cashie River. Seventhly, I give and bequeath to my son, William Anthony after the death or marriage of my wife Ann Maritta, the tract of land on which I now live, except for fifty acres I sold to Nelson, a colored man I raised. Eighthly, I give and bequeath to my grand daughter, Martha Ann (Daughter of Mary) two hundred acres of ***** land on the side next to my son, Joseph Cooper land. Ninthly, I give and bequeath to my daughter, Elizabeth all the remainder of the master tract of land. I hereby nominate, constitute and appoint my friend Furman (?) Wilson my Executor.
