Ruffin my Real Estate, it being the Tract of land bought from Mrs. Willie Hamlin. 3rd I hereby appoint my daughter, Mary B. Ruffin my Executrix to execute this my last will and testament. In the event of the death of my daughter, Mary B. Ruffin then I direct that my daughter Louisa A. Ruffin shall be my Executrix. Witness my hand and seal this the 1st day of Februrary 1900. Henry Ruffin (seal) Witnesses: Luke Pierce, Harvey Roscoe page 403 Superior Court Bertie County The paper writing here to attached and purporting to be the last will and testament of Henry Ruffin deceased, is this day exhibited before the undersigned Clerk of the superior Couty of said County by Mary B. Bond, nee Mary B. Ruffin, the Executrix named therein, and the due executrix thereof by the said Henry Ruffin is proved by the oath and examination of Harvey Roscoe, one of the subscribing witnesses there to, has testified that he is a subscribing witness to the said paper writing now shown him that the said Henry Ruffin in his presence subscribed his name at thr end of said paper writing and declared the same to be his last will and testament, and that he the said Harvey Roscoe, at the request and in the presence of said Henry Ruffin subscribed his name at the end of said will as an attesting witness thereto and that at the time when the said will was so executed the said Henry Ruffin was of sound mind and memory of full age to execute a will and was not under any restraint, to the knowledge, information or belief of said deponent. And said Harvey Roscoe further testified that Luke Pierce the other subscribing witness to said will signed the same as a witness in his presence and that he saw him sign the same and that said Luke Pierce is now dead. And the execution of the said papers writing purporting to be the last will and testament of Henry Ruffin, deceased is furhter proved by the oath and examination of T.C. Bond, R.W. Askew and A.C. Mitchel who testified that Luke Pierce, a subscribing witness to the same is dead. that they are well acquainted with his handwriting and that the name of said Luke Pierce subscribed to the said will as an attesting witness as aforesaid is in the proper handwriting of said Luke Pierce and that their knowledge of the handwriting of said Luke Pierce is derived from having frequently seen him write. The the execution of the said paper writing purporting to be the last will and testament of Henry Ruffin deceased is further proved by the oath and examination of T.C. Bond, R.W. Askew and Jas T. Bond, who testified that they are well acquainted with the handwriting of said Henry Ruffin and that the name of Henry Ruffin subscribed to the said apaper writing is the proper handwriting of said Henry Ruffin and that their knowledge of the handwriting of said Henry Ruffin is derived from having frequently seen him write. The said paper writing and every part thereof is adjudged to be the last will and Testament of Henry Ruffin, deceased and the same together with this certificate ordered to be recorded and filed. This the 8th day of May 1909 W.L. Lynn, Clerk Superior court pg 505 In the matter of the will of Henry Ruffin, dec'd Superior Court before W.L. Lyon Mary B. Ruffin [note:error, should be Bond] (nee Ruffin) being duly sworn doth say, that Henry Ruffin, late of said County is dead, having first made and published his last will and testament; and that she is the Executrix named therein. Further that the property of the said Henry Ruffin consisting of horse, cattle, hogs, farming implements, household and kitchen furniture, money, etc is worth about $100. So far as can be ascertained at the date of this application, and that Sarah Ruffin, widow of deceased, and Mary B. Bond, Louisa A. Smallwood, and Jas H. Ruffin, his children, all of them are 21 years of age and reside in Bertie County are the parties entitled unto said will to the said property. Mary B.
