Bladen County, NC - Paterson (or Peterson) v Cheek, 1754 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ North Carolina S. Ct. March General Court 17?? (date smeared) William Cheek late of the County of Granville in the said Province Lawyer, otherwise called William Cheek of Bladen County in North Carolina, was summoned to answer John Paterson of a Pleas that he render to him Eighteen Pounds Six Shillings Currant Money of Virginia, which he owes to him & unjustly detains &c. And wherefore the said John Paterson by Robert Jones Junior his Attorney Complains, that whereas the said William Cheek on the twenty fourth Day of October in the year of our Lord God one thousand seven hundred and forty six at the County of Granville aforesaid by his Bill obligatory acknowledged himself to be bound unto the said John Paterson in the sum of Nine Pounds three Shillings Currant Money of Virginia to be paid to the said John Paterson upon demand, and to the said payment well & truly to be made the said William Cheek by the said Bill firmly bound himself his Heirs, Executors and Administrators in the penal sum of Eighteen Pounds Six Shillings Currant Money of Virg'a. And the sd John Paterson in Fact says that the said William Cheek hath not paid the said Nine pounds three Shillings to the said John Paterson, altho' the said William Cheek afterwards to viz on the aforesaid twenty fourth Day of October, in the year aforesaid at the County aforesaid he was requested to pay the same by the sd John Paterson, which upon that Demand the said William Cheek ought to have paid him according to the Tenor & Effect of the sd Bill hereby an Action has accrued to the sd John Paterson to demand and have of the said William Cheek the said eighteen pounds six shillings above mentioned. Yet the said William Cheek although thereto requested afterwards, to wit, on the aforesaid twenty fourth Day of October in the year above said, at Granville County afores'd by the sd John Paterson but has hitherto refused & still doth refuse to pay the same to the Damage of the said John Paterson Ten pounds Sterling Money of Great Britain, and thereupon he brings Suit &c. And he brings here into Court the aforesaid Bill Obligatory, which Testifies the said Debt in Form aforesaid the Date whereof is on the Day & Year above mentioned &c.
