I Jesse Peek of the state of North Carolina and County of Buncombe being feble in body but of sound mind and memery Thanks be given to God do make and ordain this my last will and testament as touching such worly estate wherewith it hath been pleased God to bless me in this life I will and dispose of the same in the following manor and order that is to say First I give unto Jemima my beloved wife all and every? My stock grecin vessels utensils and property of every kind to have and to hold and to dispose of to her own use also I give unto her all my land estate being on the waters of Hayses Run in the County of Buncombe North Carolina to make use of in any way as her needs may require holding peaceable possession of the same so long as she may remain my widow and also in particular I will and bequeath unto her in an unlimited maner one side sadle and one bed with the clothing thereof which she may use give or bequeath as she thinks proper for ever and when she shall be done with those things bequeathed to her then shall that which may remain of such estate as I have given her for such limited time be either equally or unequally divided between my two nephews Jesse Peek son of my brother William Peek and Jesse A. Peek son of my brother Jas Peek and Thomas Floyd at the discretion of said Jemima in whose care I shall have left it as she may think right or proper only no part coming to Thomas Fooyd (sic) shall be transferred to his kind except to a lawfull issue.
