STATE OF NORTH CAROLINA    
COURT OF  PLEAS & QUARTER SESSIONS   
BURKE COUNTY          
April Term, 1808

HENRY SMITH and JOHN KIRBY and wife

      Vs.

JOHN McCRARY and wife and others, Heirs of SOLOMON SMITH

It appearing to the satisfaction of the Court that the defendants, SAMUEL SMTH 
and JOHN MCCRARY in right of his wife, CELIA, are not inhabitants of this 
State. It is therefore ordered by the Court that publication be made for three 
successive weeks at the Raleigh Minerva, that unless the said Defendants 
appear at the next term of this Court to be held for the County of Burke in 
the Court House in Morganton on the 4th Monday in July next and plead, answer 
or demur to this petition, the petitioner's petition will be taken pro 
confesso and heard ex parte.
