Between J O Whisnant of the county of Rutherford and State of North Carolina of the first part and William Terry of the county of Burke and said State of the second part. Wetnepeth of the party of the first part for and in Consideration of the sum of $50.00 in hand paid by the party of the second part the reciept whereof is hereby acknowledged hath given, granted, bargined and sold to the party of the second part a certain tract of land lying and being in the County aforesaid and State waters First Broad River adjoining lands of L H Smart and others. Beginning on a Spanish Oak on the bank of the B Spring Branch and Nens No 50 W 76 poles and said branch and Hard Bargain Creek to a hickory on the Bracket line thence North said line S.0 49 W 87 poles to a pine on said line thence. So distance unknown to a Black Guin a conditional corner made by J P Whisnant and L H Smart. Thence with the top of the ridge as it meanders to the McCurrys line, thence with McCurry teng Shal Creek to the beginning. To have and to hold, and the party of the first part doth bargain, sell, Enfeoff and Confirm to the party of the second part his heirs Exs adm and apogren forever all the aforesaid land to have and to hold in fee simple forever in testimony whereof I have set my hand and affixed my seal in the presence of. Except the minerals that was reserved by the Speculators. The word Spanish Oak was underlined before the Apegnment. Be it remembered that J P Whisnant and wife Eliza M Whisnant has this day acknowledged the due execution of the annexed deed and the said Eliza M Whisnant being examened by me seperate and apart from her said husband touching her pu consent to the same she states that she signed the same of her own free will and accord without fear or compasion of said husband of any other person and she still ---- apoints to the same this January the 18th 1888 J P Whisnant E M Whisnant J C Upton (JP) North Carolina Rutherford Co. The foregoing certificate of J M Mode and J C Upton Justices of the Peace in Rutherford Co. is adpedged to be correct. Therefore let the instrument with the Certificates be -----.
