All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Judy Brickhouse sesdvs@hotmail.com August 11, 2013, 4:07 pm Source: Family Search Written: 1883 State of North Carolina Burke County April 30, 1860 I ANDERSON DENTON of the County and State aforesaid being of sound mind & memory but considering the uncertainty of my earthly existence do make and declare this my Last Will and Testament in the manner form following that is to say: First: That my Executor herein after named shall provide for my body a decent burial suitable to the wishes of my relatives and friends, and pay all funeral expenses together with my just debts howsoever and to whosoever owing out of the monies that may first come into his hands as a part or parcel of my estate. Item 1st: I give and bequeath unto my beloved wife JANE DENTON all my real and personal estate except otherwise mentioned hereafter consisting of 376 acres of land including my dwelling house where I now live, all the houses belonging to my premises and also all my present crops and all rents of lands belonging to me tilled by my tenants, also one horse and colt now belonging to me and six head of cattle, seven hogs, all my sheep, One two horse wagon, together with all my present stock of provisions, farming tools, clock, bureau all looking vessels and kitchen furniture with all my books and beds & bed steads and all clothes and cloth etral-I possess, Also every thing I now possess (unless otherwise mentioned hereafter) to have and to hold to her the said JANE DENTON for and during the time of her natural life. Item 2nd: I do hereby constitute my trusty friend JOHN R. DENTON my lawful executor to all interests and purposes to execute this my Last Will and Testament according to the true intent and meaning of the same and every part and clause thereof. Item 3rd: But if my Wife JANE DENTON marries at any future period after my decease then this my Last Will and Testament to be utterly void and every clause to be null and of no force, and all my estate to be equally divided among my proper heirs. Item 4th: But if my Wife DANE ELIZA DENTON remains a widow after my decease then she shall be possessoness of every thing which I possess at my decease of both real & personal lands and tenements goods and chattels and every thing appertaining to the estate during the time of her natural life and at her death all properties to be equally divided among the proper heirs. Item 5: The afore named Executor shall have power to sell according to as much property of the aforesaid estate, as will pay all just debts and the said Executor to be accorded fees according to land for his services. I hereby revoke and declare utterly void all other wills and Testaments by me heretofore made. DENTON Her x mark See order Appointment of Executers page 113 State of North Carolina Burke County In the Probate Court A paper writing purporting to be the Last Will and Testament of ANDERSON DENTON deceased is exhibited before the undersigned Judge of Probate for said County by JOHN R. DENTON the Executer therein named and the due execution thereof by said ANDERSON DENTON by the oath and examination of JOSEPH A. DENTON and ELIZA DENTON the subscribing witnesses thereto who being duly sworn doth depose and say and each for himself doth dispose and say, that he is a subscribing witness to the paper writing now shown herein purporting to be the Last Will and Testament of ANDERSON DENTON: That the said ANDERSON DENTON in the presence of this deponent subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date the 30 day of April 1860. And the deponent further saith That the said ANDERSON DENTON the Testater aforesaid did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his Last Will and Testament and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto and at the request and in the presence of the said Testator. And this deponent further saith that at the said time when the said Testator subscribed his name to the said Last Will as aforesaid and at the time of deponents subscribing his name as an attesting witness thereto as aforesaid the said ANDERSON DENTON was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of the deponent!!
