Harris and Elizabeth I. his wife of the county of Cabarrus and State of North Carolina of the one part and John C. McEachern of the county of Cabarrus and state of North Carolina of the other part. Witnesseth that the said party of the first part for the consideration of the sum of eight hundred and seventy five dollars to the said party of the first part in hand paid the receipt of which is hereby acknowledged hath sold and conveyed and doth hereby sell and convey to the said party of the second part all that tract or parcel of land lying in the county of Cabarrus and state of North Carolina bounded as follows to wit lying on Back Creek and Rockey River adjoining the lands of Samuel C. Harris, Robert Kirkpatrick, S. F. Gilmer and others a portion of which was a tract formerly owned by Hector McCachern and by him willed to John McEachern his son and by him willed to the said John C. and Elizabeth J. his children upon which tract the said John McEachern lived at the time of his death and the other parcel of said tract comprising about fifty acres which was apportioned to said John C. and Elizabeth J. in the division of the lands of Casius? McEachern children containing in the whole about one hundred and seventy eight acres more or less the interest of the said Elizabeth J. therein being an undivided morety thereof. To have and to hold the same with the appurtenances thereunto belonging to him the said party of the second part his heirs and assigns forever and the said party of the first part for the consideration aforesaid doth hereby covenant and agree to warrant and defend the premises aforesaid to the said party of the second part his heirs executors administrators and assigns against the claim and entry of all persons whatsoever and they do further covenant that they are seized of the premises in fee simple and hath power to make and convey such an estate by this indenture and hath done the same by these presents to the said John C.
