CABARRAS COUNTY, NC - WILLS - Daniel D. Barnhardt, 18 Sept 1877 --------------¤¤¤¤¤¤-------------- Last Will and Testament of Daniel D. Barnhardt North Carolina, Cabarrus County: Probate Court March 10, 1879 A paper writing purporting to be the said will and testament of Danl Barnheart is this day admitted to Probate in open court which is in the following words and figures to wit: I Danl Barnheart being in feeble health but of sound memory do make and publish this as my last will and testament hereby revoking and rendering void all wills or codicils here before made by me I desire that all my just debts of every kind shall first be paid including such funeral expenses as are suitable to my situation in life. I give to my beloved wife Eveline Barnheart during her natural life the free use and control of the saw Mill tract of land adjoining Henry Plott And others containing (77) acres and I do further give and bequeath unto her any and all personal property that may be on hand at my death including all money, gold dust, Gold coin, Silver and greenbacks that may be on hand at the time of my death. Also all horses cows hogs sheep and all personal property of every kind which is on hand at my death the same is given in addition to the tract of land this day deeded to her, and free her from any debts of any kind which I may owe at my death. I desire and devise that my Executors here in after named shall sell all the real estate remaining undisposed of and after pay my all of my debts from the money realized by a sale of said land, all costs and expenses of sale should divide the same in seven (7) equal parts first charging the children of my daughters Betsy Hinse with three hundred dollars and then pay to each of my children now living one share and to Elizabeth Hinses children one share, to Adam Barnhearts child one share and the remaining share to D. C. Barnhearts children. If any of the aforesaid children should be under 21 years of age that their share of the aforesaid money shall be paid to their Guardian or in case any of children should die before I do then their share be paid to such of their children as are living at the time of my death. I do hereby appoint as Executors of this my will Paul Barnheart and my beloved wife Eveline Barnheart they do have power to dispose of said lands without giving bond.
