CABARRAS COUNTY, NC - WILLS - George Barnhardt, 2 May 1870 --------------¤¤¤¤¤¤-------------- Last Will and Testament of George Barnhardt North Carolina, Cabarrus County - May 2nd, 1870 I, George Barnhardt being of sound and disposing mind and memory, have thought proper this day to make publish and ordain this my last will and testament in manner following to viz: 1st After my decease it is my will that my body be buried in a decent Christian manner after the order of our Church at the expense of my Estate and that my Executors erect a suitable monument to designate the place of my remains. 2nd I give and bequeath to my son John M. Barnhardt one hundred and sixty acres of land on the East-side of Bear Creek and North part of my tract of Land adjoining Sarah Troutman's Land. Beginning on Sarah Troutmans line, on the West side of Bear Creek and running down the west side of the Creek to a Branch thence on Eastern direction to strike the corner of the woods, running East with the fence to a bend, then an Eastern direction to include the number of acres, and be charged Three hundred and twenty dollars as Legacy for the said Land. 3rd I give and bequeath to my two sons Alfred B and James E. H. Barnhardt the remainder of my plantation whereon I now live being about six hundred acres to have and to hold as their property and received as part of their Legacy for the sum of twelve hundred dollars. I also will them with the plantation my thrashing machine Windmill and all other fixtures belonging to said Thrasher, my mower and its appendages, straw cutter, hay rakes, two ploughs, my Blacksmith tools, two matlocks, two hoes, water buckets, table ware, table corner cupboard, bed and desk, Sofa, candle stand, my clock, chairs, corn sheller, fire tongues and shovel, dog irons, Looking glasses 4th It is my will that my son John M Barnhardt and James E. H. Barnhardt are to have an outfit in property, or money equal in value to the outfit of the rest of my children. Outfit is designated on my memorandum book. 5th It is my will, that my Executors allot my Books in nine equal lots to be distributed among my heirs. 6th The money I paid for Dr J. L. Cunninghams Margaret A. and Laura's Toom Stones will be deducted as Legacy from the heirs of Cunninghams. 7th It is my will that the property not willed be sold by my Executors and the money arising from said sale, with money on hands notes Bonds and Stocks be converted into money or held by my Exectrs at their option, and make a division of such Bonds that can be divided, or notes, to make the heirs equal. 8th The Estate going to the Children of George F. Barnhardt dec'd I appoint Marshall L. Barnhardt Trustee to take in hand their Legacy and account for it according to Law. 9th The Estate going to the Children of Margaret A. Cunningham dec'd I appoint David Cress Trustee to take in their Legacy and account for it according to Law. 10th It is my will that my Estate be equally divided in value between John M. Barnhardt, Julian Corl, Jacob C. Barnhardt, Children of Margaret A. Cunningham dec'd Children of George F Barnhardt dec'd, Alfred B. Barnhardt, James E. H. Barnhardt, Marshall L Barnhardt, Martha J. Cress. The amount received and receipted and entered on my memorandum book as charged will be taken in account as so much Legacy received and distributed to the above named Legatees and theirs representatives. 11th I do hereby appoint my two sons Jacob C. Barnhardt and Marshal L. Barnhardt Executors of this my last will and testament, In witness thereof I have hereunto set my hand and seal. Moose I George Barnhardt the within named testator do hereby make and publish this codicil in addition to my last Will and Testament bearing date A. D. 1870 in Manner following to wit; Item 1st I give and bequeath to my sons John M. Barnhardt and James E. H. Barnhardt in addition to the for will, All the grain and forage on hands; and that which may as on mutate hereafter. All the provisions on hand, Two mules and their harnesses, six head of Cattle, six head of sheep, and all of my hogs. In witness whereof I George Barnhardt have hereunto set my hand and seal this 31 day of July, in the year of our Lord One Thousand Eight hundred and seventy one.
