CABARRAS COUNTY, NC - WILLS - George H. Barnhardt, 13 Jul 1891 --------------¤¤¤¤¤¤-------------- Last Will and Testament of George H. Barnhardt State of North Carolina, Cabarrus County In the matter of the last will of Geo H Barnhart R A. Dry being duly sworn douth say: That Geo H Barnhart late of said County, is dead having first made and published his last will and testament, and that R A. Dry, J. D Harkey & J H Moore are the executors named therein. Further that the property of the said Geo H Barnhart consisting of personal and real estate is worth about $4000.00 so far as can be ascertained at the date of this application and that Mt. Olive Church, Mary E Barnhart, Jno A Harkey, John L Dry, Rufus A Dry, Laura E Tucker & Mary Jane Milton are the parties entitled under said will to said property- Sworn to and Subscribed before me this 21 day of Jany 1892 Rufus A. Dry Jas C Gibson Clerk Superior Court A paper writing purporting to be the last will of Geo H Barnhart decd is this day offered for probate which is in the following words and figures to wit - In the name of God, Amen I, Geo H Barnhart of Drys Mills in County of Cabarrus and the State of North Carolina, being of sound mind and memory considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my last will and Testament: That is to say First after all my lawful debts are paid and discharged the residue of all my estate, real and personal I give, bequeath and dispose of as follows to wit To my beloved Mt. Olive Evangelical Lutheran Church in N O Township in Cabarrus County and the State of North Carolina Two Hundred and Fifty dollars. I also give and bequeath One Third of the remainder of my estate to my Beloved Mother if she is living at the time of my decease. I also desire that the rest of my property, real and personal shall be equally divided among Jno A Harkey, Jno L Dry, Rufus A. Dry, Mrs Laura E Tucker, Mary Jane Milton. If my mother is not living at the time of my death, my estate shall be divided among the above mentioned relatives and their heirs. But if I marry and have any heirs my estate shall be divided as follows: One third to my wife and the remainder to my heirs. If no heirs the remainder to be divided equally among my Brothers and Sisters. Likewise I make constitute and appoint R. A. Dry, J. A. Harkey and J. H. Moore Esqr to be executors of this my last will and testament. In witness Whereof I have hereunto subscribed my name, and affix my seal this 13th day of July A D 1891 Signed Geo H. Barnhardt (Seal) Wit Jno A Harkey Wit W T Stallings In Superior Court Jany 21, 1892 In re the last will & testament of Geo H Barnhardt From the foregoing affidavits M T Stallings, G. H. Cox and V C Lutz witnesses, the Court finds that the said paper writing, purporting to be the last will and testament of Geo H Barnhardt decd and every part thereof is in the hand writing of said Geo H Barnhardt. And from the foregoing affidavits of Geo H Cox and D M Moore the court finds that the said paper writing was found after the death of the said Barnhardt among the valuable papers. It is therefore considered and adjudged that the said paper writing and every part thereof is the last will and testament of Geo H Barnhardt. It is ordered that the same be recorded and filed as the last will and testament of Geo H. Barnhardt, R A. Dry, J A Harkey & J H Moore the executors therein named having qualified as such.
